ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING SECTION 90 -64 OF THE WICHITA FALLS
CODE OF ORDINANCES 70 EXPAND THE HOURS OF CURBSIDE
PLACEMENT OF CITY COLLECTORS, FINDING AND DETERMINING
THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED
WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the use of roll -off containers provides greater security for the
disposal of municipal solid waste, and
WHEREAS, Section 90 -64 of the Code of Ordinances restricts the hours during
which citizens are allowed to place their roll -off containers at curbside for collection, and
WHEREAS, the greater security provided by the roll -off containers allows for less
restrictive hours for placement of such roll -off containers at curbside for collection.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT
SECTI 1 . Section 90 -64 of the Wichita Falls Code of Ordinances, Placement
for City Collectors, is hereby amended at subsection (b), so that such subsection shall
hereafter read as follows:
"(b) Containers for automated collection shall be placed at a point adjacent to
the street on the side so designated by the sanitation division to facilitate cost effective
and efficient service. Containers shall be placed at the curb no earlier than 5:00 p.m. on
the day before the scheduled collection day. Every resident shall ensure the container
is at least five feet from any horizontal obstruction as well as 12 feet from any vertical
obstruction. Containers shall be removed from the curb no later than 11:59 p.m. on the
day of collection."
SEC TIO N 2 . It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
