Ord 047-2004 6/15/2004ORDINANCE NO. 1 A - amq ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, GRANTING MIDWESTERN STATE UNIVERSITY A WAIVER FROM THE WATER RESTRICTIONS CONTAINED IN SECTION 106 -186 OF THE CODE OF ORDINANCES, PROVIDING AN EFFECTIVE DATE; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, Midwestern State University (MSU) is the host for the Final Four Men's and Women's Soccer NCAA Division II Championship to be conducted in December 2004; and, WHEREAS, in order to provide safe and appropriate field surfaces for such championships, it is necessary for MSU to water the fields as necessary, utilizing appropriate water conservation measures; and, WHEREAS, MSU has begun efforts to provide for its future watering needs with the assistance of well water; and, WHEREAS, it is desirable to grant MSU a waiver from the water rationing ordinance adopted by the City Council, in order to provide adequate irrigation to the fields, to decrease the risk of personal injury to the staff and players utilizing said fields. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. MSU is hereby granted a waiver from the provisions of Section 106 -186 of the Code of Ordinances for a period of ninety (90) days from the effective date of this ordinance. This waiver only applies to the athletic, fields to be utilized by Midwestern State University as part of the NCAA Division II Soccer Championships. SECTION 2. In consideration of the City Council of the City of Wichita Falls granting this waiver, MSU agrees to reduce its consumption of water at all other university facilities, and shall comply with all other provisions of the City of Wichita Falls water rationing provisions not inconsistent with this waiver. SECTION 3. The fact that immediate watering of the field facilities is necessary to insure safe playing facilities for the NCAA Division II Championships, so as to reduce the potential for personal injury, requires that the ordinance shall go into effect immediately upon passage, and it is so ordained. SECTION 4 . It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
