ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, WAIVING SECTIONS 14 -384, 50 -97, 82 -58, 82 -62,
82 -63, AND 82 -68 OF THE CODE OF ORDINANCES, AND
RESOLUTION 2509, AS AMENDED, TO PERMIT THE GIVING AWAY
OF GOLDFISH, THE NON - PAYMENT OF THE $100 PYROTE -CHNIC
PERMIT FEE, THE DRIVING OF VEHICLES OR ANIMALS ON THE
GRASS, THE SALES OF GOODS OR WARES, THE POSTING OF
SIGNS, THE POSSESSION AND CONSUMPTION OF ALCOHOLIC
BEVERAGES, AND SALES WITHOUT PAYMENT OF THE
PERCENTAGE OF GROSS TO THE CITY, DURING THE FALLS FEST
ANNUAL EVENT IN LUCY PARK SEPTEMBER 21 -26, 2004; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the Falls Fest Steering Committee wishes to host their annual Falls
Fest event September 24 -25, 2004 in Lucy Park, and;
WHEREAS, in order for the event to be more successful they request permission
to not pay the $100 pyrotechnic permit fee, give away goldfish, sales without payment
of the percentage of gross to the City, possession and consumption of alcoholic
beverages, posting of signs, and vehicles and animals on the grass.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF )NICHITA FALLS, TEXAS, THAT:
SECTION 1 . Sections 14 -384, 50 -97, 82 -58, 82 -62, 82 -63, and 82 -68 of the
Code of Ordinances, and Resolution 2509, as amended, are hereby waived to permit
the giving away of goldfish, the non - payment of the $100 pyrotechnic permit fee, the
driving of vehicles or animals on the grass, the sales of goods or wares, the posting of
signs, the possession and consumption of alcoholic beverages, and sales without
payment of the percentage of gross to the City, during the Falls Fest annual event in
Luce Park September 21-26, 2004.
SECTION 2 . It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
