ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, WAIVING SECTIONS 82 -58, 82 -62, 82 -63, AND 82 -68
OF THE CODE OF ORDINANCES, AND SECTION 5420(5) OF THE
ZONING ORDINANCE TO PERMIT VEHICLES ON THE GRASS,
SALES, THE POSTING OF SIGNS, POSSESSION AND CONSUMPTION
OF ALCOHOLIC BEVERAGES, AND AN EXCEPTION TO ZONING
DURING A BBQ EVENT BY THE SIGMA NU FRATERNITY IN SOUTH
WEEKS PARK SHELTER OCTOBER 2, 2004; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Sigma Nu Fraternity of MSU wishes to conduct a BBQ Battle
event in the south Weeks Park shelter October 2, 2004 that will benefit the American
Cancer Society; and
WHEREAS, in order for their event to be more successful they request
permission to post signs, possess and consume alcoholic beverages within 300 feet of
the shelter, drive vehicles upon the grass for public parking west of the access road,
and conduct sales; and
WHEREAS, the fraternity has committed to organized clean up after the event,
use caution against underage alcohol consumption, and provide traffic control, if
necE�ssary.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . Sections 82 -58, 82 -62, 82 -63, and 82 -68 of the Code of
Ordinances, and Section 5420(5) of the Zoning Ordinance are hereby waived to permit
vehicles on the grass, sales, the posting of signs, possession and consumption of
alcoholic beverages, and an exception to zoning during a BBQ event by the Sigma Nu
Fraternity in south Weeks Park shelter on October 2, 2004.
SECTION 2 . It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
