Ord 069-2004 9/7/2004ORDINANCE NO. l9Q" aO O4 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, CLOSING AND ABANDONING A 20 -FOOT ALLEY CONSISTING OF APPROXIMATELY 4,163.36 SQUARE FEET RUNNING FROM GRACE STREET TO CLARK STREET, ALSO KNOWN AS LOT 1 -A, BLOCK 26, CARUTHERS SUBDIVISION OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, Biggs & Mathews, Inc. has at the request of United Regional Health Care Systems (URHCS) asked that the city close and abandon the 20 -foot alley located between Grace Street and Clark Street in the 1200 block for the purpose of building a parking lot, and WHEREAS, all affected utility companies and City departments have been contacted and have conditionally approved of this closure with the retention of the utility easement, and WHEREAS, the City Council of the City of Wichita Falls, Texas deems it advisable and in the public interest to close and abandon this alley hereinafter described subject to the application being made and a final plat submitted to the City within six months of the date of this ordinance. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT SECTION 1 . The 20 -foot wide alley containing approximately 4,163.36 square feet located between Grace Street and Clark Street in the 1200 block, also known as Lot 1 -A, Block 26 of the Caruthers Subdivision, is hereby closed, abandoned and vacated. SECTION 2 . In consideration of the receipt of Eight Thousand Three Hundred Twenty -Seven Dollars ($8,327.00), this ordinance shall authorize the City Manager to execute a quitclaim deed for the City's interest in the property. The deed shall be executed conditioned upon URHCS making application and filling an approved re -plat of the property in the records of the Wichita County Clerk. This application shall be made and fee paid shall occur within six months of the date of approval of this ordinance. This ordinance shall be void and have no effect if said re -plat is not approved and filed within the stipulated time period. SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law.
