ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, CLOSING, ABANDONING, AND VACATING A
TWENTY (20) FOOT WIDE By APPROXIMATELY ONE HUNDRED
SIXTY TWO (162) FOOT LONG PORTION OF AN ALLEY ADJACENT
TO PROPOSED LOT 24 -A (CURRENTLY LOTS 24 -31), BLOCK ],
FAITH VILLAGE UNIT 1, AS INDICATED ON THE ATTACHMENT "A'
LOCATION MAP, FINDING AND DETERMINING THAT THE MEETING
AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, Gary Broyles, tlba Classic Builders, has requested closing,
abandoning, and vacating the portion of the alley as described above and indicated on
the attached plat map; and
WHEREAS, all affected City departments and affected utility companies have
been contacted and have approved or conditionally approved this closure with the
retention of the utility easement, and
WHEREAS, the City Council of the City of Wichita Falls, Texxas, seems it
reasonable and in the public interest to close, abandon, and vacate this portion of the
alley hereinafter described, subject to the application being made and a final plat
submitted to the City within six months of the date of this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT
SECTION 1 . The 20 foot wide by approximately 162 -foot long section of the alley
containing approximately 3,240 square feet located adjacent to Lots 2441, Block 7,
Faith Village Unit 1, is hereby closed, abandoned, and vacated Said alley is shown as
indicated on the attached map, incorporated in this ordinance as Attachment 'A
SECTIO 2. In consideration of the receipt of One Thousand Six Hundred
Twenty Four and No/100 ($1,624.00) Dollars for the fair market value of the property
and One Hundred Fifty and Noi ($160.00) Dollars for the appraisal fee, this
ordinance shall authorize the City Manager to execute a quitclaim deed for the City's
interest in the property. The deed shall be executed conditioned upon the property
owner's filing of an approved re -plat of the property in the records of the Wichita County
Clerk. This filing shall occur within six (6) months of the date of approval of this
ordinance ,
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
