ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, CLOSING, ABANDONING, AND VACATING A
25 -FOOT BY 165 -FOOT SECTION OF AN ALLEY ADJACENT TO
LOTS 5 AND 6 OUT OF BLOCK 255, GULLEY AND JAMES
SUBDIVISION, WICHITA FALLS, WICHITA COUNTY, TEXAS,
THOSE ADJACENT LOTS ALSO KNOWN AS 1508 AND 1510
ELEVENTH STREET; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, United Regional Health Care System has requested closing,
abandoning, and vacating the portion of the alley as described that is part of a
proposed project, and
WHEREAS, all affected City departments and affected utility companies
have been contacted and have approved or conditionally approved this closure
with the understanding required improvements will be at applicant's expense,
and
WHEREAS, the City Council of the City of Wichita Falls, Texas deems it
advisable and in the public interest to close, vacate and abandon that portion of
the alley hereinafter described subject to the filing of a final re -plat within six
months of the date of approval of this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WICHITA FALLS, TEXAS, THAT:
SECTION 1 . That 25 -foot wide by 165 -foot wide portion of the alley
located between Lots 5 and 6 out of Block 255, Gulley and James Subdivision,
such lots also known as 1508 and 1510 Eleventh Street, Wichita Falls, Wichita
County, Texas, is hereby closed, abandoned and vacated. Said alley is shown
as indicated on the attached map, incorporated in this ordinance as Attachment
., „
SECTION 2 . In consideration of the receipt of Nineteen Thousand Nine
Hundred Twenty Dollars and No /100 ($19,920.00) for the fair market value of the
property, and One Hundred Fifty Dollars and Noll 00 ($150.00) for the appraisal
fee, this ordinance shall authorize the City Manager to execute a quitclaim deed
for the City's interest in the property. The deed shall be executed conditioned
upon the property owners filing an approved re -plat of the property in the records
of the Wichita County Clerk. This filing shall occur within six months of the date
of approval of this ordinance.
SECTION 3 . It is hereby officially found and determined that the meeting
at which this ordinance was passed was open to the public as required by law.
