ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS. CONSIDERING AN APPEAL OF CONDITIONAL USE
PERMIT# C 04 -34', FINDING AND DETERMINING THAT THE MEETING
AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, on October 13, 2004 the Planning and Zoning Commission
conditionally approved a request for a conditional use permit to construct a "Self -
Storage Facility /Mini Warehouse" at 2203 Missile Road; and
WHEREAS, the following conditions were placed on the permit.
I. Paint all (metal) fence components black or green and set the fence back 5 feet
from the property line along street frontages.
2. Provide landscaping sufficient to reduce the visual impact as outlined In the staff
report
3. Designate as exit only the curb cut off of Hooper Dr. or redesign so that there is
n o stacking of vehicles In the street.
4. Provide a curb cut off of Missile Road to reduce traffic onto residential streets.
5. Provide brick exterior on all buildings.
6. Provide an 8r tall privacy fence on alley side.
7. Direct lighting away from neighboring homes', and
WHEREAS, a citizen has appealed the Planning and Zoning Commissions
decision to the City Council as allowed by Section 7245 of the Zoning Ordinance; and
WHEREAS, upon review of Conditional Use Permit # C 04 -34, the City Courcil
deems it in the public interest to deny the permit.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT
SECTIO 1 . Conditional Use Permit # C 04 -34, conditionally approved by the
Planning and Zoning Commission on October 13, 2004, is hereby denied.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
