Resolution Approving Amendment No. 1 Authorizing A Guaranteed
Maximum Price Of $3,730,640 In The Construction Manager At Risk
Services Contract With Gallagher Construction Services For The
Construction Of The Wichita Falls Animal Services Center, And
Authorizing The City Manager To Execute All Documents Necessary
To Approve Trade Contractors And Subcontractors In Accordance
With TEx LOCAL GOV'T CODE §271
WHEREAS, the City Council finds that the City has validly used the procedures
described in Subchapter H of Chapter 271 Of the TEXAS LOCAL GOVERNMENT CODE t0
obtain construction manager at risk services for the construction of a new Animal
Services Center and complied with other statutory provisions related thereto;
WHEREAS, on July 7, 2009, the City Council awarded a contract to Gallagher
Construction Services to serve as Construction Manager at Risk for the construction of
a new Animal Services Center; and
WHEREAS, as part of that contract, Gallagher Construction prepared a proposed
Guaranteed Maximum Price for the construction project, and said price must be
approved by the City prior to obtaining trade contractor and subcontractor bids in
accordance with TEx. Loca� Gov'T Co�E §271.118.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
Amendment No. 1, authorizing a guaranteed maximum price of $3,730,640 in the
Construction Manager at Risk Services Contract with Gallagher Construction Services
for the construction of the Wichita Falls Animal Services Center, is hereby approved
with such to be in a form approved by the City Attorney, and the City Manager is
authorized to execute said Amendment and all documents necessary to approve trade
contractors and subcontractors for this project, in accordance with TEx. LocA� Gov'T
CooE § 271.118.
