Resolution Authorizing The City Manager To Execute An
Agreement With Insituform Technologies Inc. For Emergency
Wastewater Line Repairs In The Amount Of $58,920.00
WHEREAS, during routine line inspections, wastewater crews discovered
a main wastewater line break near the intersection of Jalonick Street and Scott
Street. This line is located under the exiting BNSF Railroad spur which serves
Attebury Grain and Taylor Foundry, and it must be repaired as soon as possible
to preserve the integrity of the railroad spur;
WHEREAS, Insituform Technologies has provided a proposal to pipe-
burst this 510 foot section of line at a cost of $58,920 in accordance with pricing
and specifications provided for the Buy-Board Cooperative Purchasing contract;
WHEREAS, Texas Local Government Code § 252.022 provides that the
state's competitive bidding requirements do not apply to:
(1) a procurement made because of a public calamity that
requires the immediate appropriation of money to relieve the
necessity of the municipality's residents or to preserve the
property of the municipality;
(2) a procurement necessary to preserve or protect the public
health or safety of the municipality's residents;
(3) a procurement necessary because of unforeseen damage to
public machinery, equipment, or other property; and
WHEREAS, the City Council finds that repair of the aforementioned sewer
lines were procurements in accordance with the aforementioned exceptions to
the state's competitive bidding requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WICHITA FALLS, TEXAS, THAT:
The City Manager is authorized to execute an agreement with Insituform
Technologies Inc. for Emergency Wastewater Line Repairs in an estimated total
amount of $58,920.00 in accordance with the attached Proposal prepared in
accordance with its Buy-Board Cooperative Purchasing contract and documents
submitted thereto.

INSFNFORAA T£CHNOLOGIE3, Inc. herein proposes to furnish all fabor, materials, equipment, and services necessary to
reCOnstruct the referenced project utilizing the Texas StaYewide Cooperative Purchasing Contract (#326-09)
administered through the BuyBoard.
ASSUMPTIONS AND QUALIFICATION3
Laterals. During N inspection al! side sewers are verified, using best practicat efforts, to determine if each is an
active hook up. Normal practice only reinsiates those, which are active. You may direct us to reinstate all or
specific laterals, as you desire. This praposal, unless othervvise stated, assumes that all laterals will be reconnected
extemally. Specific service connections will not be reconnected only when written directions are received from the
Owner. The Owner will indemnify and hold In�s�ruFORM TecHnw�ocies, INC. harmless from all Gaims arising from
backups and other effects pertaining ortiy to service laterals and the written request from the OwRer to not reinstate
specfic lateral connections. Service reconnections will not include any additional lateral line replacement except
that which is necessary to recannect the service line between the mainline and the property line. Two service
conrtections were ident�ed on the pre video inspection. However, oniy one is included for external
reconnection as the other is assumed to be dead. If it is detertnined that both should be reconnected, then
ail line items associated with exteroal reconnects will be charged twice.
The pricing in this proposal assumes that all Technical Specifications set forth by the BuyBoard wiil be strictly
adhered to.
Insitufortn Technologies, Inc. wiil supply the City of Wichita Falls the necessary Maintenance, Payment, and
Performance Bonds if required, following the acceptance of Yhis proposal.
Insituform was provided a recent video inspection by the City of Wichita Falls for use in preparing this proposal.
This video will serve as our pre-N for the work to be completed. No other pre-TV will be performed by Insituform.
The City of Wichita Falls wil! be responsible for any permits required for fhe project to Incfude those
necessary for the Rail Road and TXDOT.
Water shall be provided at no cost to InsituForm Technologies, inc. for all constructlon phases of this project.
Insituform Technologies, Inc. will foiiow all required deposR, backflow prevention, and metering procedures.

Terms and Conditions from the Texas Statewide Cooperative Purchasing Contract are available upon request from
the BuyBOard. Any changes to these conditions must be noted and agreed upon by both parties.
