Resolution Approving A Third Generation Non-Annexation
Agreement With Nustar Logistics, Limited Partnership, Guaranteeing
Its Immunity From Annexation For A Period Of Fourteen Years
Beginning Retroactively To January 1, 2007
WHEREAS, the City of Wichita Falls entered into a second generation
non-annexation agreement with NuStar Logistics, L.P., (formerly Shamrock Pipeline) for
a period of seven years from January 1 , 2000; and
WHEREAS, the City of Wichita Falls desires to enter into a third generation non-
annexation agreement with NuStar Logistics, L.P. for a period of fourteen years from
January 1, 2007.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
The City Manager is hereby authorized to enter into a Non-Annexation
Contract with NuStar Logistics, L.P., a copy of which is attached hereto, whereby the
City guarantees the extraterritorial status of property used by NuStar and its immunity
from annexation by the City for a period of 14 years from January 1 , 2007, with changes
as approved by the City Attorney.
