Item 1 - Call to Order
The City Council of the City of Wichita Falls, Texas met in regular session on the above
date in the Council Chambers of the Memorial Auditorium Building at 8:30 o’clock a.m., with
the following members present.

Mayor Barham called the meeting to order at 8:30 a.m.

Item 2a - Invocation
Pastor Mike Rucker, Bible Baptist Church , gave the invocation.

Item 2b - Pledge of Allegiance
Mayor Barham led in the Pledge of Allegiance.

Item 3 – Presentations – University Kiwanis Club – Dan Chilenski

Dan Chilenski presented a check to Mayor Barham on behalf of the University Kiwanis
Club. It is the annual contribution for the concessions at Kiwanis Park. He thanked the Mayor
for their help at the Park. Mayor Barham said the Kiwanis Club has been an essential part of
that park.

Item 4 - Comments from the Public to Members of the City Council Concerning Items
That Are Not on the City Council Agenda.

Ken Lambert, 1809 Eden Lane, spoke against the addition of fluoride to the water. He
noted there are other cities that have stopped adding fluoridation. He discussed the cost and
said that about 90 percent of water goes down the drain. He spoke about medical hazards of
the fluoridation. Mayor Barham said he is not concerned about the level of fluoride in the water.
Lynn Smith and Michael Smith, PO Box 4431, said they were interested in the Fire
Station on Miller Road. They would use the building as their new office. They submitted bids
on both options. They were the high bidder with both options. They told the council their choice
is option one, which is for the fire station without the addit ional acreage. He said they
considered demolishing the building and building a new business. To build a new building, they
would lose two of the trees. They decided to refurbish the existing building, enhancing the
visual look as an old-time fire station. He said he would like the fire department to use the
property as a fund-raising location. Mayor Barham explained that this item will be discussed by
the council during an executive session.

Item 5 - Consent Items

City Manager Darron Leiker gave a briefing on the items listed under the Consent Agenda.
Moved by Councilor Smith that the Consent Agenda be approved.
Motion seconded by Councilor Ingle and carried by the following vote:

Item 5 - Approval of Minutes of the October 6, 2015 Regular Meeting

Item 6 – Public Hearing to Determine if Certain Buildings and/or Structures are to be
Considered Dangerous

Mayor Barham opened the public hearing at 8:50:59 AM.
Jim Dockery said the code enforcement department has identified 17 structures that are
dangerous and need to be demolished or brought to code following the permit process.
Rita Miller reviewed the following structures:

1. 1401 24th Street (main structure)
There were no comments.
2. 1208 32nd Street (main and accessory structures)
There were no comments.
3. 1330 32nd Street (main structure)
Nestor Ledesma, 1904 Burroughs, said the house is his fathers. He said he
doesn’t have the funds to repair the house or to tear it down. He said he has done his best to
keep the house boarded up and the lawn mown. He is willing to let the city demolish the
structure and he could make payments on a lien.
4. 1519 Elizabeth Avenue (accessory building only)
There were no comments.
5. 2008 Elizabeth (accessory structure only)
This structure has been demolished and should be removed from the list.
6. 403 Fillmore Street (main and accessory structures)
There were no comments.
7. 605 Fort Worth Street (accessory structure only)
There were no comments.
8. 1707 Giddings Street (secondary living quarters only)
There were no comments.
9. 2210 Harvard Street (main structure)
There were no comments.
10. 1623 Ivy Lane (main structure)
Thomas Simon, 2000 Noxbridge Road, Forney, Texas, said he and his siblings received
the property in probate in 2013. He has been unable to sell the property. He said he would like
the city to demolish the property and he will make payments on a lien.
11. 6204 Kemp (mobile home and accessory structure)
There were no comments.

12. 101 Lee Street (accessory structure only)
There were no comments.
13. 101 Mill Iron Avenue (main structure)
There were no comments.
14. 1025 Ridgeway Drive (main structure)
There were no comments.
15. 706 Ross Avenue (main and secondary living structures)
Victor Saenz, 600 Ross, requested time to make necessary repairs to the structure.
Mayor Barham said a 30-day period to request a permit and 90 days for substantial work would
be allowed.
16. 1307 Trout Street (accessory structure only)
Clarence and Madge Matthews, 5632 Mount Storm Way, Fort Worth, said they received
the property at the death of Mrs. Matthews’ mother. They received the property about the same
time they got the notice from the city and have contracted with Christmas in Action for
ownership and repair of the property. He asked that Christmas in Action be given the time
extension. Mayor Barham said the request would be granted.
17. 2130 Yale Avenue (main structure)
Ray Ramirez, 2130 Yale, said he wants to fix the house. Mayor Barham said the time
extension would be given.
There were no other comments and the public hearing was closed at 9:10:42 AM.

Item 7a – Ordinance #49-2015

Ordinance No. 49-2015
Ordinance Finding Certain Buildings and/or Structures to be Dangerous; Requiring
Property Owners to Demolish Said Buildings and/or Structures within Thirty (30) Days of
the Date of this Ordinance and Declaring an Emergency and Immediate Effective Date
Moved by Councilor Chenault that Ordinance No. 49-2015 be passed.
Motion seconded by Councilor Smith.

Motion by Councilor Ingle to amend the ordinance to remove Property #5 because it has
been demolished and to remove Properties #15, #16, and #17 to allow a 30-day period for permit
application and a 90-day period for substantial completion on the repairs.
Motion to amend seconded by Councilor Smith and carried by the following vote:
Ayes: Mayor Barham, Councilors Ingle, Smith, Santellana, and Chenault.
Nays: None
Motion on the amended ordinance carried by the following vote:
Ayes: Mayor Barham, Councilors Ingle, Smith, Santellana, and Chenault.

Item 9b – Items of Concern to Members of the City Council

Councilor Ingle said some people thought the city was encouraging people to use more water
so the city could generate more revenue. He clarified that that idea is not correct.

City Council went into Executive Session at 10:03:36 AM in accordance with Texas
Government Code §551.072 and §551.071.
City Council reconvened at 11:14:11 AM.
Mayor Barham announced that no polls or votes were taken during Executive Session.

City Council adjourned at 11:14:17 AM .
