SECTION 1. Be it ordained by the Uity Council of the
City of Wichita Falls, State of Texas that the �Ilestern
Union Telegraph uompauy, its successors acid assigns
are authorized to erect and maintain, on the Streets .
Alleys and public ways of said City, the Voles and
fixtures and wires necessary for the purpose of supplying
t the uit .zees of said city, and the public, commuiiicati on
by telegraph, or other unproved electrical device, such are
to be and continued upon the terms and conditions herein
after stated.
SECTIOI1 11 The location of the poles ;nd lines
now in use is I,,ereby approved, €eta d the location of all
poles €nd lilies hereafter to be erected, and 6ny change
in the location of the poles and lines now in use, or
extensions thereof, shall be under the direction of and
control of the City UOuileil of said city.
SECTION 111. Said poles ,Ind wires shell be placed
and maintained so as not to interfere with travel on said f
City higr:,ways and slid Company shall hold s,-,id uity free�,�`
and harmless from all damage arising by reason,, of ally
abuse of said occupancy. This grant is made and is to
bei enjoyed , subject to such reasonable regulations , and
ordinances of a police nature, as said council, of said
City of Wichita falls , is authorized and sees proper, at
any time, to adopt, not destructive of the right he -ein
granted.
¢ SECTION 1Y. The right of use herein given shall
not be exclusive, and the council of said city reserves
the power to grant a like right-of-way to any other
Telegraph Uompany the same however, not to interfere
with the reasonable and proper use of Vie privuledges
herein granted.
SEC`1'IUIT V. n consideration thereof, said 'Nestern
Union telegraph company shall, and by the acceptance of
this ordinance sloes agree to allow the City u-ouncil , of the

top cross-arm of any of said poles, where practicfble ,
the City rir e Alarm and police wires alid said poles are
' hereby made municipal instrumentality for that purpose,
r provided however, said attachment s'-.all be made and
maintained under the direction of said Uompany's
manager in said Uity of liehita Falls, the Said Company
hall and will furnish for said city the use of its

Then said UomparY will remove sLtid lilies and poles from
the streets Land alleys of said Uity within sixty days
from date that said Uompany ceases to use and operate
said lines.
SECTION 9111. All ordiliances and parts- of ordinannces
orders and resolutions upon the subject of telegraph
poles, wires etc. , of previous date, in so far as the
same relates to the Weptern union Telegraph Oompany
are hereby replaced and cancelled.
