BE IT ORDAINED BY THE CITY COUNCIL OF TTE CITY OF VIXCHITI FALLS,TEXAS.
See. 1, That the Wichita Falls Light and Power Company, its sus-
cessors and ssigns, be and are hereby gTanted the right to erect and main-
tain over and -.Jong and across the streets, alloys, and public hig,.wayo
of the City of Wichita Falls, Texas, the poles, guy poles wire, guy tire,
fixtures and all other apparatus necessarily incident to the oreration of
the Light Plant for the purpose of of supplNing the citizens of said City,
and the ,,ublic generally rrith light and electric power.
See. 2 The location of the lines and Toles now in use in the
said City of "ichita Falls, Texas, over the various streets, alleys, and
highways to hereby ax,,Proved, excepting that sunoh -oles as are in the gatters
shall be moved v.-,h(-n the City requires, but in the location of the line
hereafter to be constructed, shall be done under the dir6otion and approval
of the City Council.
SEC. 3, The poles, wires, and other fixtures shall be so construct-
ed as not to interfere Y,,,,ith the free use amd occupancy of the streets,
alleys, end highways of said City by the public and ohall be so onstruct-
ed as not to injure in anyway, pavements or other public property and the
method rif constructiob, shall be subject to the approval of the City
Council of the City of Wichita Falls*
See. 4e The said V:ichita Falls Light and Power Company binds it-
self by aceeptanag hereof to hold the -1fid d City ofiVichita Falls, Texas,
harmless from any and all damages of any kind mud character on account of
the use and occu-nnoy of its streets and alleys by the said 23:t7 Wichita
Falls Light and Power Oompanyo The said City merely grants the right o;g
way over its streets- and ire no-,'.=7 sense assumes any obligations
either in oversight or management of said br.3iness,
See. 5* The franchise as granted is made and to be enjoyed sub-
ject to such reasonable rules, ord.inandes and police regulations as said
City Counci& shall,hereafter see fit to make in reference to the business
of said 'Y"ichita Falls Light and Power CoiTpanye The said City aldo, binds
itself to enact such e)rdinanoes as are necessary to pro-teat the -property
of said Company from wilftl injury,
Sec. 6. This fi°anchise is not exclusive but the right is reserved
to grant other like granchises.
Sec. Ve The said 'iiohita Falls Light and Power Comapny grants to
the City the use of any of its poles for its use in attaching fire alarm
boxes without any charge to the City, but ,.,,uch attachments shall be made
and maintained uLnder the mitual direction of the City and s,-;.i& Company.
This franchise is granted. for the period of f!O years from the date
hereof.
