BE IT 07,DAIMEM BY THE CITY COUNCIL OF TIPE CITY OF V,7CHITA PALLS,
TEXAS:
That the 'd'lic'r_ita and Charley Telephone Conippny, its successors
and assigns be and is hereby granted right to erect and maintain over,
along and across the streets, alleys, and public highways of the City
of Wichita Falls, Texas, the poles, guy,-poles, wires, guy-wires, fixtures
and all others apparatus necessarily incident to the operation of the
Wichita and Charley Telephone CompangTs line.
The location of the lines and poles now in use in said City
over the streets alleys, and highways is hereby approved, excepting that
such poles as are in gaiters shall be moved when the City requires, but
in the location of the lines hereafter to be constructed shall be done
under the direction and approval of the City Council.
The poles, '. irew, and other fixtures shall be sox c instructed
as not to interfere with the free use and occupancy of the streets,
alleys, and highways of said City by the public, <<-,nd shall be so con-
structed as not to injure in any z:;ay pavements or other public property
and the method of constructidn shall be subjee.t to the approval of the
City Council of the City of Wichita Falls, Texas.
The said Wichita and Charley Telephone Cowpany binds itself by
the acceptance hereof to hold the said City harmless from any and all
ddmage of any kind or character on the account of the use and occupancy
of its streets, alleys, and public highways by said 7irichita and Charley
Telephone Co. The said City merely grants the right of way over its
streets and in no sense assumes any obligations either in oversight or
management of said business.
This franchise as granted is made and to be enjoyed subject to
such rules, ordinances, and police regulations as said City Council shall
hereafter see fit to make in reference to the business of said Wichita
and Ch arley Telephone Co.
The said City binds itself to enact such ordinances as are
necessary to protect the property of Laid company from wilful injury.
This franchise is not ell-clusive but the -right is reserved other
and like granchises.
Said Wichita and Charley Telephone Company grants to t.h.e C3ty
the use df any of its poles for use in attaching fire alarm boxes, wires,
and police wires, but such attachments shall be made and maintained under
'-he mutual direction cif the City and said Company.
This ordinance shall take effect and be in force from and after
its passage as required by law.
