CITY OF WICHITA FALLS IN WICHITA COUNTY, TEXAS, AND GRANTING To
THEM AND THEIR ASSOCIATES AND ASSIGNS MIE RIGHT TO UEE THE STREETS
AND ALLEYS OF THE CITY CIF IWICHITA FALLS, UPON CERTAIN TERMS qm

Sec* I* T.E. Dobson and Y.A. Marcus and their
associates and assigns arehereby granted the right to construct
operate and maintain over, along and across all of the streets,
alleys, and �nublic highways of the City of Wichita Falls, Texas,
the necessary roles, wires,, conduits and other tblmgs necessary
f6r them operation #f an Electric Light and Power Plant in said
City and the furnishing of the inhabitants of said City with
Electricity for light and power.
See. 2* The plant shall be constructed and all
poles, wires and conduits shall be constructed in such manner as
not to interfere with the free use by the public of the streets,
alleys and public highv-'ays shall be when in any manner di-turbed
by the said T.E. Dobson and M.A.. Marcus and their associates
or assigns promptly repaired at the cost and expense of the said
T.E. Dbbson and M.A. Marcus and their associates or assigns, and
the location of all pokes, wires, -,nd conduits shall be subject
to regulation and contro& by ordinances of the City of Wichita
Falls, whioh have been heretofore passed of may be hereinafter
enacted. prescribing the manner of construction or location of
such poles, - ires, and conduits,
siad - Sec* 39 In consideration of t is fvmohise the
T.E.Dobson and M.A. Marcus and their associates and assigns
agree that the maximum which shall ever be charged J"or electricity
furnished by them upon am meter basis shall not exceed eleven cents
per KiloWat hour and that whenever a customer shall pay his bills
for the preceeding month by the tenth of the following month that
such bills shall be discounted ten per cent and that whenever a
customer shall use more than fifty Kilowatt hours during any one
month that All electricity _-Furnished in excess of fifty Kilowatt
hours during said month shall be charged for at the rate or seven
cent,-, per !"ilowatt hour provided, however, that the minimum charge
upon a meter basis shall be t12000 per antrum, and it it further
provided that all meters for the measure of eleotrioity to customers
shall be furnished by the said T.E. Dobson and M.A. Marous and their
associates or assigns,

from oontraoiing v.1th consumers of electricity 'or furnishing
the same without meainirement by zmeter upon such terms as may be
mutually altreed upon.
Soo. 4. The said T.E. Dobson, and MVA. Maro#s
and their asp-ociates and assigns shall when required, to do 9D by
resolution or ordinance of the City Council duly passed, place
all vvires in such portions of the City as said Council may direct
in conduits undergroundq but 73hall have a right to place distribut-
ing poles in alleys under qirection of the Council.
Sec* 5, The said T.E. Dobson and M.A. Marcus and
their assooiatoo or assigns shall furnish all persons who may wish
to prooure electricity from then for light or power such elootricity
whenever such person is within 200 feet of any oft their wires,
but shall unddr no circumstanoe disorimbAte, between customers

Sea. 6, This franchise is granted for a Perieft
of twenty five �v ars.
Sea. 7. The said T.E. Dobson and M.A. Maxdus
and their associates and assigns in cob.sideration of this franchise
further agree that the City of Wichita Palls may place a system of
fire alarm Vixen and fixtures on all or any of their poleel the
same to be attached under the stapervisi6nn of the ovmers of the
electric systems at such places as they think best but it the ex-
pense of the City and the same shall be maintained by said City.
Sec.8. This franohis.e shall lapse and be df no
force and effect unless construction begins within thirty days
from the passing of this ordinance and the plant shall be in oper-
ation within six months from the time construction begins.
Sec. 9. The said T.E. Dobson and M.A. Marche
and their associates and�zsigns further agree that, they will
immediately upon the jgrantgng of tharsds franchise begin and finish
as speedily as po,:>sible the construction of conduits for their
wires under ground in all that section of theCity, which has been
ordered to be paved by the City Council and for which a contract
has been let.
Sec,10* The said T.E. Dobson and M.A. Marcus and
associates or assigns agree to furnish the City Electricity for
light and fans in the City Hall and fire station free of charge
nit to exceed, however, electricity sufficient, for forty thirty
two candle mower incandescent, lights burning six hours a day.
Sec. lU Any wilfAl failure on the xa rt of the
said T.E. Dobson <ind M.A. Marcus and their associates or assigag
or a refusal upon their part on demand, of the City Council to
oomph with the r •ovision hereof sh,11 be ground for forffiture of
this franchise.
See* 12. The said T.E. Dobson and M.A. Marcus and
their associates :Ind assigns obligate and bind themselves by accept-
ing this franchise to iudennify and s; ve harmless the City of Wichita
Falls for all the damages costs and expenses, rhich the City may in-
aur or for which it may be liable by reason of any negligence on the
part of the ,!aid T.E. Dobson and M.A. Marcus and their associates
and assigns in oonstruettng, operating or maintaining their plant,
Sec. .13, The said T.E. Dobson _�nd M.A. Marcus
shall within three days after the passage hereof s file a written
acceptance of this franchise 1,Ith the City Seatetary.
Sec. 14. The conditions requiring the passage of
this ordinance creates an emergency and an imperative public ne-
oessity exists requiring the rule on three several days to be sus-
pended and that this ordinance shall take effect and be In fordo
from and after its passage sand it is so enacted..
