That attached to this ordinance is a map on which is shown in
red lines the course of said pilc- lines and the streets and alleys
to be used by the Panhandle Refining Company under this ordinance,
and said map is hereby made apart of this Ordinance , and the said
Panhandle Refinin Company is hereby authorized to construct a pipe
line over and across all city property which may be touched by said
line when constructed substantially as shown by the red line on the
map which is attached hereto and made apart of this Ordinance, but
this Ordinance shall not be construed as granting the Panhandle
Refining Company any rights upon any private property,,' railroad
Said Panhandle Refining Company is hereby ,ranted the right to
excavate in said streets and alleys as above set out aid to lay pipe
line or pipe lines for the conveyance of -fuel oil in and under the
eurface of said etrE'ets, and. gelaert�lly to do any and all things which
nrc neceL— ary and proj.er to be done to carry out the purpo.--e of con-
ve.yine,- ftial oil in said pipe lines ,roll along said streets.
The foregoing giant and frrinchise , however, is given under the
exilress condition that said pipe lines shall be laid at a depth of
at least eighteen (18) inches below the grade of said streets and
alleys, such grade to be fixed by the City Engineer, and shall be
laid in such parts of the street as the City Engineer may designate
and upor the further express condition that saik,". streets and alleys
shall not be unnecessarily damaged nor obstructed by the operations
of the said Panhandle Refining, Company, and upon the further express
condition that said. P,,-.nhan(lle '-Refinine,, Co.-,-Qpnn-,, shall, when said
work is finished along any part of said Etreets and alleys, 8,s
sieedily as i)ractically, restore said streets n.nd alleys to their
original condition, and from time -1W-r) time shall. refill its trenches
and do any and all things which are nece,--,sary to keep said streets
alleys in no good condition as the same were before its lines
were laid,,
IV.
The said. Panhandle -"efininp. Company by accepting this
Ordinance agrees and binds itself to indemnity and save harmless
the City of Wichita Falls against all Suits and claims for damages
of any aid every character which may arise or may be assessed
ray
against said City by reason of any act or tiling done or failed
to be 6one by said Panhandle Refining Company, and said Panhandle
refining Company Dirther agrees at its own cost and expense to
defend any and. all suits , which may be brought against the said
City of "'ichita Falls by reason of any act or thing which may
be done by it or any failure on its ;-art to do any act or think;
in connection with the la;1,inLz, of said pipe lines and the maintenance
of the same, wid agrees to indemnify the City of Wichita Falls
against oll charges and costs of every character including
attorney'a fees.
V.
This Ordinance shall go into effect only -7!1,.en said Panhandle
R Refining Company shall 1,,.ave filed with the Secretary of the City
of "�'O'ichita Falls, Texas, a written acceptance of the same and an
agreement on its pctrt to all of the conditions ttnd provisions here-
inabove set forth.
VI.
The franchise hereby granted shall continue in force for a
period of thirty years.
