build, construct , operate , ayd maintain a spur track from a point on
the main line of the 111.1. -& IT. lRailway Company on the East side of 1,71
1,,�Assouri street in a Northerly diredtion from the South line of
,JashinL-ton 3traet ; thence in a Northerly direction across Washirzton
Street and thence along, the East ide of -i--issouri street to the
South line of Jefferson Street , for the purpose of serving the said
interstate -P'ipe Coria-pany, %:gone -property abuts on said Missouri Street ;
that the rights privileges and franchises hereby granted are -rantod
subject to the following terms and conditions, a violation of any one
of which, or a misuse or abitse of the euxae , shall constitute a suf-
ficient ground for the forfeiture of the &ntire right , privilege and
franchisehereby p-ranted, s-�Ad conditions being, as follcr.v7s to-wit :
a. That said track hereb,, a )thori!-ed shall be const-ructed
in front of said property of the Interstate Pi -e* Cori,Fnany, and shall
connect wi th the main line track of the & T. Railway Company,
and shall extend across t,-u-'hington &-treet , thence over and along and

hissouri ;street , for a distance of 500 feet , more or less , alonLc,, the
entire Vest side of Block m 35 of said City of �iichita Palls.
b. That the staid- spur -10raok shall be buy It -and constructed
under the supervision of the City Engineer and to his satisfaction
and the said grantee herein at all times, d1ring the period of this
grant , shall conform the rails tk of the sad track i:ithtthe surface
of the said street.
c . That the szLid granted shall exercise at all times great
caution and diligence not to unreasonably obstruct the public street
while using the said track.
See . 2. That the right , privilege, and franchise hereby
aranted is granted subject to the City Charter and ordinances of the
pity of 'ilichita Falls, and such future charter and ordinancem as may
hereafter be passed, _-.nd the City reserves tha right at all times to
amend or alter the franc',°Iise hereby granted.
See . 3. That the said grantee ,-,,hall at all times conform
the said tracks to ay ordered improved condition of tie said Streets
and shall contribute its pro rates part of the cost for making any
imorovb, ont on the said streets-whenever ordered by the 'Board of
Commissioners so to do.

of 10 years from the date fif its acceptance , as hereinafter provided

Be it ordained by the Board of Commissioners of the
City of Wichita galls :
I.
That the right, privilege and franchise be and the
same is hereby granted to the Interstate Llipe Com.1pany, to lay,
build, construct, operate and maintain a spur track from a
point on the min line of the 1,11. L. & T. Railway Company on
the f side of Tussouri Street in an _V direction
from the �LAhline of "'asnington Street; thence in a &U �
direction across Washington Street; and thence along the
side of mitissouri Street to the AIM line of Jefferson Street,
for the purL)ose of serving the said Interstate `ripe Company,
whose property abuts on said 1,11issouri Street ; that the rights ,
are ranted subject
privileges and franchises hereby grantedg �
to the following terms and conditions , a violation of any one
of which, or a misuse or abuse of the same , shall constitute
a sufficient ground for the forfeiture of the entire right ,
privilege and franchise hereby granted , said conditions being
as follows, to-wit :
( a) That said track hereby authorized shall be
constructed in front of ::aid property of the Interstate Pipe
Company, and shall connect Ath the main line track of the
M. K. & T. Railway Co many, and shall extend across l ashington
Street, thence over and along and in front of said property
of said Interstate Pipe Compaziy on said Missouri Street , for

a distance of 500 feet, more or less , along the entire 4e-t�
side of Block 35 of saia City of Wichita Falls .
(b) ihat tine said spur trac -shall be built and
constructed unaer the supJrvision of the City Enginaer and to
his satisfaction , and the said grantee :herein at all times ,
during the period of this grant , shall conform the rails of
the said tract; with the surface of the said : treets.
( e) That the said grantee shall exercise at all
times great caution and diligence not to unreasonably obstruct
the public Street while using the said track.
II.
That the right , privilege and franchise hereby
granted is granted subject to the City Charter and ordinances
of the City of 'Afichita Falls , and such future charter and
ordinances as may irereafter be passed, and the City reserves
the right at all times to amend or alter the franchise hereby
granted.
III.
That the said grantee shall at all times conform
the said tracks to any ordered improved condition of the said
Streets and shall contribute its pro rata part of the cost
for making any improvement on the said Streets whenever
ordered by the Board of Comr_dssioners so to do .
IV.
That the riF4ht and privilege hereby granted is
granted subject to the provisions herein contained for the
period of 10 years from the date of its acceptance , as herein-
after provided for. That the right, privilege and franchise
hereby granted shall be accepted by the grantee herein in
writing within 30 days from the date that the same becomes
finally effective under the Charter; that the said grantee
shall irtake a written acceptance of sarre and file said
acceptance with the Board of Commissioners of the City of
Wichita Falls .
V.
That this ordinance shall take effect from and after
:` I its passage as in the Charter in such cases made and provided.
