That on Jany.w7th 1910, the City Council of. the City of
'ichit Falls, Texas, did by ordinance No. 108 grant to J.A. hemp, and
Fr arL'-r_ H.ell, their associates, Successors and assigns, a franchise to
construct and operate a st2�eet oar line over and along certain .-treets
in th„ (:ity of .',i cr:ita Falls, ahich franchise and ordinance is Ylere re-
ferred to, :end,
Jhareas, the said J.A. Hemp, and Frank Dell did thereafter transfer
$aid franchise so granted to them by the said City of Wichita Falls, to
the ',ichita Falls Traction Company, a private corporation organized
und%,r the laws of the State of Texas, and,
.`,'h ereas, the said Wichita Falls Traction Company, acting under sadd
Franchise and ordinance, constructed the stneet car line in the city
of 'Iich:i.ta Falls, Te.xas,arlyd said franchise is nova in full. force and

laid in conformity ,�iith the franchise hereinbefore referred to, and all
arxendments thereto, granted to the said J.A. ?--amp, and Fran. Kell, on
the 27th day of Jany. 1910, and the came shall be laid in strict con-
formity thereto, and all amend-menu thereto. :,11 of said ;iork shall be
done ..the supervision of the city Engineer of said City. This
franchise shall torminate ,;kith the original franchise herein raferred (bo,
of which this is made a p .rt.
11. It is further e.-:pressly provided that the said Traction Company
shall restore and place in as good condition and state of repair any and
all streets as they- are at the present time, that may be excavated, all
at the sole cost and expense of the said Traction Company. And any and
all p2 voment that :may be out or excavated shall be replaced and re stored
toiqas good a condition and state of rep air as they ware jus u prior to
the said excavation and all of said wor'.,, shall be under the supervision
of trle City Engineer.
111. Be it furtlier ordained that for the reason that the nort_.ons
of the City of '11ichi ta Falls to be sorved by the above described car
lines are without adequate mennas of transportion, and that for this
reason tinis ordinance is declared to be an eme,_ eney -and- the rul re-
0 ordinances -to be read on three selx,,r date days be and the same is
hereby susTj.ond;d, and this ordinance 13 put on it s third and fiYlal read-
ing, and it is so enacted.
