WHE-SAS, street carnivals have been held in the
City of Wichita Falls every few months , and have often re-
sulted in large crowds congregating and engaging in unlaw-
ful conduct and in the victimizing of many ignorant persons,
requiring extra policemen and police regulation; and,
WIiEhEAS , there is now no law regulating the li-
censing and controlling of street carnivals , NOW `i'uE '')FOIE,

1. It shall be unlawful to hereafter hold, sponsor
operate or run a street carnival in the City of Wichita Falls
unless a permit to hold such carnival is first obtained from
the City of Wichita Falls in accordance with this ordinance.
Each person aiding or abetting in the holding of such carnival
or its subsidiary shows , concessions , amusements, and busi-
nesses shall be equally guilty of a violation of this article ,
when said carnival operates or runs without such permit. .
2. A permit shall be issued by order of the Board
of Aldermen to hold such carnival Yrhen and only when a proper
application in writing is made therefor. Such application shall
state in detail the different component parts of the carnival in-
cluding all concessions , shows , amusements , businesses and the
proposed location of said carnival , the time it is to run, and
the number of persons regularly traveling thei�ewitli , if any,
and the number of local persons connected therewith, and shall
give a complete and full plan of the proposed carnival.
3. If the proposed carnival appears to be entirely
composed of lawful amusements and lawful enterprises , the
Board of Aldermen shall determine the number of extra police
necessary to properly superintend such carnival and regulate
the anticipated crowds and carnival. ` he Board of Aldermen shall

and shall be deposited with the City Treasurer in a police
fund for policing these carnivals acid shall be spent by the
2olice Department for such purposes, and is hereby appro-
priated for such purpose.
4. if the proposed cLrnival consists in&part of
any unlawful games , or enterprises of any kind, the permit
shall be refused, and if such carnival is issued a permit and
it conducts itself in an unlawful manner in �,rhole or in part,
its permit may be revoked by the ilayor and fees paid wall be
forfeited.
5. It shall be unlawful for any carnival to operate
in whole or in part within 300 feet of any private residence ,
church, scizool after its permit expires or after it is revoked
for cause , and all persons assisting in such o-i)eration shall

policing of said carnival.
7. Any person ,�,uilty of violating any ppovision of
this ordinance upon coOMMetion shall be fined in any sum not to

8. '1'hat in the event any section, subsection, para-
graph or provision of this ordinance shall be held or declared
to be void, or unenforceable , such voil or unenforceable portion
shall be restricted to the identical pert or provisions so-elk
or declared to be invalid, a�ad such void or unenforceable portion
shall not in any manner affect or render invalid any other
part , section or provision of this ordinance.
9. ` 'his law shall not apply to street fairs
composed of local people for purely local charitable pur-
poses and without profit.
10. by reason of the absenee of any law licensing
and regulating carnivals , it is necessary for the immediate
preservation of public peace and safety that this ordinance
shall take imrlgdiate effect and this ordinance is hereby
an emergen y -plMsure aald the rule rec:uiriag ordinances to be
read on three separate days is hereby suspended and this or-
dinance.now here placed on its third and final reading and tt
shall become effective immediately upon its passage and it is
so enacted.
