Resolution Authorizing Implementation Of A Customer Facility
Charge At Wichita Falls Municipal Airport Of $3.00 Per Day Upon
Each Wichita Falls Municipal Airport Rental Car Company's
Customer Rental Contract
WHEREAS, the City of Wichita Falls has undertaken a capital improvement
program to facilitate major customer service improvements at Wichita Falls Municipal
Airport, including planning and development of a new terminal building, and the City
funds the airport operations in part with federal grants, passenger facility charges, and
other user fees;
WHEREAS, Customer Facility Charges (CFC) have been common financing
tools for landside improvements at other airports; and
WHEREAS, the City Council finds that it would be beneficial to the City and
rental car companies to provide the new terminal and associated landside
improvements to the traveling public including relocation of the rental car terminal
facilities, ready return lots, and storage facilities using CFC revenue to finance these
improvements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. The City Manager is hereby authorized to establish and periodically adjust, as
required, a daily Customer Facility Charge upon each Wichita Falls Municipal Airport
rental car company's customer rental contract.
2. The Customer Facility Charge will be collected on a daily basis for all cars
rented for 24 or fewer hours for the first transaction day, and every 24 hours for each
transaction day thereafter.
3. The Customer Facility Charge shall initially be established at $3.00 per
transaction day.
4. The Customer Facility Charge shall be collected by all rental car companies
operating at Wichita Falls Municipal Airport.
5. The Customer Facility Charge collected by the rental car companies shall be
held in trust by the rental car companies for the benefit of the Airport and shall be
remitted monthly to the City of Wichita Falls in accordance with procedures established
by the City of Wichita Falls Director of Finance.
6. Rental car companies and their agents hold only a possessory interest in the
Customer Facility Charge, and no legal or equitable interest.
7. The Customer Facility Charge referenced herein shall be collected
commencing May 1, 2010.
