Resolution Allowing Selected Trustee Properties To Be Re-Sold At
The Courthouse Steps By The Wichita County Sheriff Or Constables
As Provided By TExas Tax Co�e §§ 34.05(C) & 34.05(D)
WHEREAS, from time to time, the City of Wichita Falls, the Wichita Falls
Independent School District, and Wichita County obtain judgments in suits for
delinquent taxes, penalties and interest and the foreclosure of tax liens on properties
located in the City of Wichita Falls, Wichita County, Texas; and
WHEREAS, the District Clerk of Wichita County issues Orders of Sale pursuant
to said judgments commanding the Sheriff or any Constable of Wichita County to seize,
levy upon, advertise for sale and sell the properties, and the Sheriff or Constables bid
some of the properties off to the City of Wichita Falls, in trust for itself and the benefit of
the Wichita Falls Independent School District and Wichita County; and
WHEREAS, the City of Wichita Falls is currently holding title to several such
properties in trust for itself and the benefit of the Wichita Falls Independent School
District and Wichita County, and desires to have some of the properties resold by the
Wichita County Sheriff or Constables, as provided by TExas Tax Co�E §§ 34.05(c) &
34.05(d).
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
1. The City of Wichita Falls hereby requests the Sheriff or Constables of Wichita
County, Texas, to sell properties held by the City of Wichita Falls in trust for itself and
the benefit of the Wichita Falls Independent School District and/or Wichita County
pursuant to TExAS Tax Co�E §§ 34.05(c) & 34.05(d) and the TExas Ru�ES oF Civi�
PROCEDURE.
2. The City of Wichita Falls Property Administration is authorized to determine
which properties held by the City of Wichita Falls in trust for itself the benefit of the
Wichita Falls Independent School District and Wichita County will be sent to the Sheriff
or Constables of Wichita County for sale and when such sales will be requested.
