SEC`S' & i. That the right and permission is hereby
granted the ita Valley �?ailway Company, its successors, assigns
and lessees to enter in and upon 'Travis Street , in the City of `richita
Palls , :Texas and to construct and lay a standard guage side tract
crossing said 'rayss Street in the .=tanner as shown by the blue print
hereto attached, the side track to be built being designated in red,
and the location of said side track and the manner in which said track
will cross said 'iravis Street being shown by said blue print , which
is mar'L_ed exhibit "tk" and made a part hereof.
(SECTIO11 II. The right and permission is hereb; further
granted the i c ita Valley I ailway Company, its successors, assigns,
and lessees to operate trains and engines and cars in and upon the
track so constructed and to use same as a side track and for all the
purposes for which said side track -lay be necessary.
SE CTIOI. III. Be it further ordained that the right and
permission he L., granted the ""Achita Valley railway Company, its
successors, assigns, and lessees is subject to the following condit-
ions, to-gait :

(a) The said : ichita 'Talley =railway Company, its
successors, as igns and lessees, shall hold the City of r'ichita 2alls
Texas harmless fro:: any and all claims for damages whether for per-
sonal injury to persons or damage to property arising by reason of
the construction of said side track and by reason of the operation
of cars and trains thereupon.
(b) The iichita Valley railway Company, its successors
assigns and. l s. ees shall construct and il,laintain all necessary cros-
sings acrose said street under the supervision and direction of the
Board of al66ermen of the City of dichita Falls, or the City Engineer
of the City of +dichita .01alls, Texas.
This ordinance to tarie effect from and after its
passage as re ired by lava and it is so ordained.
