SHALL BE REFILLED: EXCEPTING WHOLESALE DIALERS
IN TINCTURE OF GINGER AND EXTRACT OF GINGER
FROM THE OPERATION OF THIS ORDINANCE: PROVIDING
THAT SHOULD A PART OF THIS ORDINANCE BE HELD
UNCONSTITUTIONAL OR INVALID THE REMAINDER OF
SAID ORDINANCE SHALL NOT BE AFFECTED THEREBY;
DECLARING AN EhMGENCY TO EXIST AND PROVIDING
PENALTIES FOR THE VIOLATION OF THIS ORDINANCE. .{

firm or corporation or association to deal ija,sell or keep
for sale within the City of Wichita Falls, ally of that
substance known as the extract of ginger or tincture of
ginger cottnnonly known as "Jake" ,which substances whether
one or more shall be hereinafter referred to as "Jake",
unless such persons ,firms, corporat ions or associations
(hereinafter termed dealer or dealers) shall before dealing
in,selling or keeping for sale, the tincture o± ginger or
extract of ginger register and file with the City Clerk of
said City of Wichita Falls, the corporate or firm name or
the individual name or names of such dealer or dealers,and
the location within the City of the place of business
occupied, or to be occupied by such dealer or dealers.
SECTION 2. It shall be unlawful for any dealer
in "Jake sell the same unless the purchaser shall first

procure and file with said dealer the prescription of a
physician licensed to practise medicine under the laws of
the State of Texas,prescribing "Jake"for the use of said
purchaser,or for the use of some other person for whom the
purchase is being made. No such prescription shall be re-
filled,and a prescription shall be required and filed with
the Beale _for each sale of "Ja elf made by any dealer.
SECTION �. All such dealers shall keep a sale
registrat n book in which shall be registered all sales
made of "Jake" . Said book shall show the names of all
persons to whom "Jake" is sold , and post office address
and street, or Hotel address; if residents of Wichita Falls,
the name of the Doctor upon whom the prescription of "Jake"
was sold, the nazie of the person for whom the "Jake" was
prescribed, it other than the purchaser, the amount sold in
each case and the date, including the hour of the sale, such
dealer or dealers shall keep on file all prescriptions
under which "Jake" is sold. Such files and the sales
registration book shall be open to the inspection of the
Police Officers of the City of Wichita Falls at all times.

Ginger unless he be a dealer or unless he has a prescription
from a physician licensed to practice medicine under the laws
of the State of Texas*

SECTION Nothing in this ordinance contained
Shall be construed as applying to sale of Jamaica Ginger made
by Wholesale dealers to dulk authorized and licensed retail
dealers within the City of Wichita Falls. Nothing in this
ordinance contained shall bP construed to apply to the sale
of the herb of Jamaica Ginger in the natural form.
SECTION t Should any Section, sentence or
clause of this ordinance be held unconstitutional or invalid
by any court of common jurisdiction,such unconstitutionality
or invalidity shall not affect the remainder of the ordinance.
SECTIONOY. In orddn that the persons,firms ,
corporations or associations who are affected by the provisions
of this jurisdiction may -,.have reasonable time in which to
comply he;�eivith, this ordinance shall not take effect or be in
force unt ..ten days have elapsed after its passage, approval
and publication as required by law;
SECTION �. Any person, firm, corporation or
association who shall violate any of the terms of this ordinanc
shall be dee.aed guilty of a misdemeanor and upon conviction
thereof shall be fined in any sum not exceeding One Hundred
and no/100 Dollars($100.00) .
SECTIONS. The fact that « ake" as herein de-
fined is being sold genlrally within the City .of Wichita Falls
for beverage purposes and that many persons have been and
are becoming intoxicated thereon, and have b6.,1-n and are engaged
` in breaches of the peace and other violations of the law as a
direct result of the purchase and consumption of "Jake" as a
beverage,all of which is to the great danger of the public,
creates an immediate public emergency demanding that the rule
requiring ordinances to be read three _times be suspended and
the rule is hereby suspended, and said ordinance is hereby
passed on one reading,and shall take effect ten days after its
passage, approval and publication as herein above provided.
SECTION Aa Any and all prdinances and parts of
ordinances in conflict with the provisions of this ordinance
are hereby repealed.
