Ord 657 12/21/1925 ORDINZCE NO.657 AN ORDINANCE PROHIBITING THE OWNERS OR _ OPERATORS OF WAGON* EXPRESS WAGON, HACK, AUTOMOBILE, MOTOR VEHICLE, SERVICE CAR OR OTHER VEHICLES LET FOR HIRE FROM USING OR OCCUPYING ANY PORTION OF A PUBLIC STREET IN THE CITY OF WICHITA FALLS,FOR THE PURPOSE OF A PUBLIC STAND; DEFINING THE TERMS ,PROVIDING A PENALTY BE IT ORDAINED BY THE BOARD OF ALDERMN OF THE CITY OF WICHITA FALLS, WICHITA COUNTY, TEXAS: SECTION 1: Unless it appears from the context that a different meaning is intended the following words shall have the meaning attached to them by this section: (A) The word "street" shall mean and include any street, avenue , alley, highway, square or park within the city limits of the city of Wichita Falls, Texas. (B) The term "public stand" as used in this ordinance means any place on a public street that is being �jianerally appropriated and used by a move wagon, hack, or hacks, automobiles, or motor vehicles, service car or other vehicles let for hire , when not engaged in the transportation of passengers, freight or property for the purpose of awaiting public or private patronage. (C) The words "for hire" in addition to their ordinary meaning, shall include any fare or sun paid or given to or received by the operator or ,owner of any , vehicle from or for any person transported therein or any fare or sum deposited in any box or receptable kept on or about such vehicle. (D) The word "person" shall include both singular and plural and shall meafh any person, firm, corporation, association, partnership or society or trustees, trustee, receiver or receivers thereof. SECTION 2: It shall be unlawful Tor any person to use or occupy any portion of a public street in the City of Wichita Falls, Texas for the purpose of a public stand, for the standing of any move wagon, express wagon, hack, automobile , or motor vehicles, service car or other vehicles let for hire. SECTION 3: Any person who shall violate any provision of this ordinance shall be guilty of a mis- demeanor and upon conviction thereof shall be punished by a fine not exceeding One Hundred Doll4re. SEDTION 4: Each and every day' s violation of this ordinance shall cohatitute a separate offense and shall be punishable as such. Passed and approved this the day of December, A.D. 1925. Section 4: Any:pIerson who shall violate any provision of this ordinance shall be guilty of a mis- demeanor and upon conviction thereof shall be punished by a fine not exceeding One Hundred Dollars. Section 5: Each and every day' s violation of this ordinance shall constitute a separate offense and shall be punishable as such. r J-1 Section 6: This ordinance ishereby oddeclared o to be cumulative of all eprovisions ordinances regulating and governing the operating of automobiles , motor vehicles, service oars and other vehicles let for hire in the City of Wichita Falls, Texas and shall not be held to repeal any of the provisions of any of such ordinances, except those ins���hethewhere gxpresshprovi�ordinances ofare this direct conflict ordinance. whereas, the present crowded and congested condition of traffic in the streets in said city creates a dangerous condition and a menace to life and property and thereby creates an emergency that the rule requiring ordinances to be read on three separate days be suspended , and it is suspended, that this ordinance is hereby passed on its final reading and one day' s publication, and it is so ordained, Passed and approved this 21st day of December, A.D. 1925. �ayor ATTEST: G i I y erk.
