ORDINANCE AMENDING SECTION 6500, ACCESSORY USE
REGULATIONS OF APPENDIX B, ZONING ORDINANCE; FINDING AND
DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Planning and Zoning Commission is recommending that setback
requirements affecting accessory buildings be amended; and
WHEREAS, the City Council concurs with that recommendation and finds such
amendments are in the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 6500, Accessory Use Regulations of Appendix B, Zoning
Ordinance, of the Code of Ordinances is amended as follows:
6500 ACCESSORY USE REGULATIONS
6510 Purpose
The purpose of the Accessory Use regulations is to establish the relationship among
principal and accessory uses and provisions governing their uses. Sections 6500
through 6599 shall be known as the Accessory Use Regulations.
6515 Residential Accessory Uses
Residential accessory uses shall include the following uses and structures and shall be
allowed on the same lot or site containing a residential use:
A. Playhouse, patios, porches, gazebos, cabanas, greenhouses and incidental
household storage buildings.
B. Home occupations as permitted under Section 5100.
C. Radio and television receiving antennas including satellite dish antennas.
D. Recreational facilities including swimming pools and tennis courts for use by
residents.
E. A single accessory dwelling unit when the principal use is single family
residential on a lot over 10,000 sq. ft. or greater.
F. Garages, carports and parking for the principal use.
6516 Accessory Building Setbacks Exception
Front setback: 25 ft. minimum, except for rear access subdivisions
where reduced setbacks as per Section 4210 shall
apply.
Side setback interior: 5 ft. minimum, except when the wall height exceeds 8
ft. or the total height exceeds 15 ft., the setback shall
be equal to the total height.
Side setback exterior; 15 ft. minimum
Rear Setback: From alley, 1 ft. minimum
From common property line as follows:
1 ft. minimum for buildings equal to or less than 150 sq. ft. in area, 8 ft. in
wall height, and 15 ft. in total height.
5 ft. minimum for buildings more than 150 sq. ft. in area, except when the
wall height exceeds 8 ft. or the total height exceeds 15 ft., the setback
shall be equal to the total height.
Within the City, where there is proposed an accessory building that is of the
same or similar style, uses materials that resembles and has the same detailing
as the primary structure, the Commission may allow an exception to setback
reauirements under Appendix A under terms of section 7200 herein.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
