ORDINANCE PLACING A MORATORIUM ON CERTAIN PROVISIONS
UNDER SECTION 6800, LANDSCAPING REGULATIONS, OF
APPENDIX C, ZONING ORDINANCE, IN RESPONSE TO RESTRICTED
WATER USE; PROVIDING FOR ESCROW IN LIEU OF INSTALLATION;
DECLARING AN EMERGENCY; FINDING AND DETERMINING THAT
THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the City Council has placed a restriction on outside watering in
response to depleted water availability; and
WHEREAS, the City has adopted landscaping regulations which require watering
for the maintenance of plant materials; and
WHEREAS, the City Council finds that placing a moratorium on the installation of
landscaping vegetation best serves the public purpose for the period of restricted water
use.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The requirement for the placement of landscaping vegetation prior
to the issuance of required occupancy permits or other such authorization is hereby
suspended until such time that the City Council or other authority releases the ban or
restriction on water use.
SECTION 2. The City may issue a temporary Certificate of Occupancy until
such time the landscaping vegetation is placed according to the approved site plan and
landscape plan.
SECTION 3. Upon the release of the ban or restriction on water use, the
landscaping vegetation shall be installed within one hundred eighty (180) days unless
evidence is provided to support the need for additional time, and as approved by the
Department of Community Development.
SECTION 4. Upon completion of the landscaping in accordance with the
approved landscape plan the City may issue a Certificate of Occupancy. Failure to
complete the required landscaping and obtain a final Certificate of Occupancy as
required herein shall subject the project to penalties in accordance with Chapter 7 of
the Wichita Falls Code of Ordinances.
SECTION 5. Prior to issuance of a temporary Certificate of Occupancy, the City
shall require cash, cashiers check or a bank draft in an amount determined by the
Department of Community Development to cover the cost of materials and installation
of the required vegetation. Such sums are to be held in escrow by the City until such
time as the required vegetation is installed by the owner.
SECTION 6. This moratorium shall not be in effect for any other provision under
Section 6800 not involving the actual placing of vegetation.
SECTION 7. Due to restrictions on water use, an emergency is created which
necessitates a moratorium on landscaping as provided herein. Therefore, this
Ordinance shall be in effect on the day of its passage.
SECTION 8. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
