AN ORDINANCE GRANTING TO THE GULF REFINING COMPANY, A
TEXAS CORPORATION WITH ITS PRINCIPAL OFFICE AT HOUSTON, IN HARRIS
COUNTY, TEXAS, A FRANCHISE AND PERMIT FOR THE CONSTRUCTION OF A
SINGLE TRACK OF RAILWAY SWITCH ON AND ACROSS MILL STREET IN THE
CITY OF WICHITA FALLS, TEXAS.
Be it ordained by the City Council of the City of Wichita
Falls, Texas;
That it is hereby granted to the Gulf Refining Company, a
Corporation with its principal office in Houston, Harris County, j
Texas, a franchise and right to construct a single line track on,
upon and across Mill Street in said City of Wichita Falls, Texas,
as follows:
BEGINNING at a point on the railroad right-of-way of the
Wichita Valley Railway; THENCE in a southeasterly direction across
Mill Street; THENCE in a southeasterly direction on to Block
No. 2 of McBride 's Second Subdivision to said City; . THENCE in a -
southerly direction and along the western margin of said Block
No. 2 to a point on the north line of alley, as more fatly set
forth by print dated December 18th, 1925, attached.
The said Gulf Refining Company is hereby authorized to con-
struct said track as above indicated, but it is expressly provided
that said track when constructed shall conform to the grade of
said street, and the said Gulf Refining Company binds itself and its
agents to keep said track and that portion of the street affected
by it in such condition as to not unnecessarily interfere with the
use of the said street by the owners of any adjoining property.
The said Gulf Refining Company in accepting this franchise
and permit further agrees and obligates itself to lay such track
according to such directions as may be designated by the City
Engineer of said City, and to build said track as speedily as
possible consistent with existing conditions.
The said Gulf Refining Company by accepting this ordinance
and franchise agrees and binds itself to indemnify and save harm-
less the City of Wichita Falls, Texas, against any and all claims
and suits for damages of any and every character which may arise,
;or which may be assessed against said City by reason of any act
or thing done or failed to be done by the said Gulf Refining Company
in the construction of said track, and the said Gulf Refining Company
further agrees at its own cost and expense to defend any and all
suits which may be brought against the said City by reason of any
act or thing which may be done by it or any failure on its part to
do any act or thing in connection with the laying said track and the
maintenanee of same and agrees to indemnify the said City against
all charges and costs of every character whatsoever.
This ordinance shall go into effect whenever the said
Gulf Refining Company shall have filed with the City Clerk of the
:City of Wichita Falls, Texas, a written acceptance of the same, and
agreement on its part to all provisions and conditions hereinbefoae
;set forth. The franchise hereby granted shall continue to be in
force and effect for a period of thirty (30) years.

costs of every character whatsoever.
2.
The said Gulf Refining Company accepting this-
ordinance and franchise agrees and binds itself
and as part consideration herein that in the event
that that portion of Mill Street in said city,
where its railway tracks are laid, is ever paved,
that the Gulf Refining Company will pay all cost
in.putting a solid reinforced concrete base under
its tracks and agrees to pave between its tracks
and to pave eighteen inches on each side of its
tracks at its own expense and according to the
specification of the City Engineer and Board of
Aldermen of said city.
This ordinance shall go into effect whenever
the said Gulf Refining Company shall have filed
with the City Clerk of the City of Wichita Falls,
Texas, a written acceptance of the same, and
agreement on its part to all provisions and con-
ditions hereinbefore set forth. The franchise
hereby granted shall continue to be in force and
effect for a period of thirty(30) years.

WHEREAS , by virtue of. Ordinance No. 679 , the Gulf
Refining Company , a corporation created and existing under
the laws of the State of Texas , with its principal office
at Houston, in Harris County , Texas , was granted a franchise
and permit by the Board of Aldermen of the City of Wichita
Falls , Texas , for the construction of . a single track of rail-
way switch on and across Mill Street , in the City of Wichita
Falls , Texas; and,
WHEREAS , by the terms of said ordinance , it is pro-
vided that said ordinance shall go into effect whenever the
said Gulf Refining Company shall have filed with the City
Clerk of the City of Wichita Falls , Texas , a written accep-
tance of the same and agreement on its part to all provisions
and conditions therein set forth;
NOW, THEREFORE , KNOW ALL MEN BY THESE PRESENTS ,

its Vice-President , in considers,
tion of the benefits accruing to it by virtue of the passage
Qf said ordinance , does hereby accept said ordinance , and
does hereby agree to all the provisions and conditions there-
in set forth.
