ORDINANCE WAIVING SECTION 4220, SUBSECTION B, OF
APPENDIX C, WICHITA FALLS CODE OF ORDINANCES TO ALLOW A
FENCE WITHIN THE FRONT SETBACK AREA ALONG WEEKS
STREET IN THE DAVID A. KIMBELL, JR. PROPERTY SUBDIVISION;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, the Planning and Zoning Commission has recommended a waiver
of Section 4220, Subsection B, to allow a fence within the front setback area that
exceeds the limitation of said section; and
WHEREAS, the City Council of the City of Wichita Falls concurs with the
Planning and Zoning Commission's recommendation.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 4220, Subsection B, of Appendix C, Wichita Falls Code of
Ordinances, Zoning Ordinance, is hereby waived to allow a fence within the front
setback back area along Weeks Street in the David A. Kimbell, Jr. Property Subdivision
that exceeds the limitations of said section.
SECTION 2. This waiver shall be approved with the condition that the proposed
fence be constructed according to the attached plan, incorporated in this ordinance as
Attachment "A ".
SECTION 3. If the construction of the proposed fence is not complete within two
(2) years of the passage of this ordinance, this waiver shall expire and shall have no
effect.
SECTION 4. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
