AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, AMENDING CHAPTER 31 OF THE CODE
OF ORDINANCES, ENTITLED "VEHICLES FOR HIRE," AT SECTION
31 -74, TO PROVIDE FOR AN EXCEPTION TO THE ONE -HOUR
PREARRANGED APPOINTMENT FOR A SPECIAL SERVICE
VEHICLE; PROVIDING FOR INCLUSION IN THE CODE; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS,
TEXAS, THAT:
SECTION 1. That Chapter 31 of Section 31 -74, entitled "Definitions," be
amended to hereby read as follows:
"Sec. 31 -74. Definitions.
For purposes of this article, a "special service vehicle" is any chauffeured motor
vehicle for general passenger use which operates within the city on a prearranged
appointment basis only, whereby such arrangement is made not less than one (1) hour
in advance of the time transportation is to begin. A "limousine" is any chauffeured motor
vehicle manufactured by a commonly recognized manufacturer of luxury automobiles,
including but not limited to, Cadillac, Lincoln, Mercedes, Lexus and Rolls Royce, which
operates within the city upon request made by a customer at the dispatching office or
principal place of business of the franchise holder. The definition of limousines or
special service vehicles shall not include "courtesy vehicles" which are utilized by hotels
or motels.
The transport of physically or mentally challenged persons from a residence to a
medical facility, or from one medical facility to another, or from a medical facility back to
a residence, shall be exempt from the one -hour advance appointment requirement
specified herein.
In the event an application for a special service vehicle franchise comes before
the city council and either the applicant or the city council desires to restrict the
franchise to a defined customer base, the city council may specify these restrictions in
the approving ordinance. Examples of customer bases may include but not be limited to
elderly /disabled transport only, medical related transport only, general transport."
SECTION 2. It is the intention of the City Council of the City of Wichita Falls,
Texas, that the provisions of this ordinance shall become a part of the Code of
Ordinances of the City of Wichita Falls, Texas, and that sections of this ordinance may
be renumbered or relettered to accomplish such intention.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
