Ord 765 5/10/1926ORDINANCE NO. 761fC.-I AN ORDINANCE PROVIDING FOR THE HOLDING OF AN ELECTION IN THE CITY OF WICHITA FALLS, TEXAS, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY, WHO ARE PROPERTY TAX PAYERS THEREIN, A PROPOSITION FOR THE ISSUANCE OF BONDS OF SAID CITY IN THE AtJOUNT OF 100000.000 FOR THE PURPOSE OF RAISING F URDS TO PAY THE COST OF EXTENDING AND IMPROVING THE SANITARY SEWERAGE SYSTEM IN SAID CITY AND LEVYING A TAX ON ALL TAXABLE PROPERTY IN SAID CITY TO PAY THE PRINCIPAL AND INTEREST OF SAID BONDS, AND DECLARING AN EIERGENCY. WHEREAS, the Board of Aldermen of the City of Wichita Falls, Texas, deems it necessary and expedient to borrow money on the credit of the City in the sum of $100,000.00, and secure the payment thereof by the issuance of bonds of said city in that amount for the purpose of raising funds to pay the cost of extending and improving the sanitary sewerage system in and for said city. Now Therefore, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF WICHITA FALLS, TEXAS: Section 1: Tt an election be held in the City of Wichita Falls on the /&W day of June, A. D. 1926, at which election the following proposition shall be submitted: Shall the Board of Aldermen of the City of Wichita Falls, be authorized to issue bonds of the City of Wichita Falls in the sum of 4100,000.00, to mature serially from one to forty years from the date thereof, bearing interest at the rate of four and three-fourths per centum per annum, payable semi-annually, for the purpose of providing funds for the extension and improvement of the sanitary sewer system in and for said city, and to levy a tax sufficient to pay the interest on said bonds as it accrues, and the principal thereof at maturity. Section 2: The said election shall be held at the City Hall and in the Wichita County Court House in the City of Wichita Falls, Texas, and shall be conducted by the following named persons: J. N. Protho, Presiding Judge, Court house Box; J. No Bland, f J. M. Williams,l Clerks. W* S. Abbott r F. B. Mashburn, Presiding Judge City Hall Box; Lou Jenne; I P. H. Leath, j Clerks. Robert McCullough] Voters living East of Lamar Street and Northeast of dichita River and Southeast of the Wichita valley Railway Tract in said city shall vote at the City Hall Box. All voters living West of Lamar Street in said city shall vote at the Court House Box• Section 3: The said election shall be held in accordance with the general election laws and only qualified voters who are property tax payers in said city shall be allowed to vote• Section 4: The ballots to be used at said election shall contain the proposition substantially as above set forth followed by the words "for the issuance of bonds" and "against the issuance of bonds." Section 5: Notice of said election shall be given for at least thirty days by the Mayor, by publication in the Wichita Falls Record Dews, a newspaper of general circulation in Wichita County, Texas, published in the City of Wichita Falls, and such notice shall be made by publishing a copy of this ordinance with the words "Notice of Wleotion" prefixed thereto, once a week for three consecutive weeks in said newspaper, and the first publica- tion to be made at least thirty days preceding such election. Section 6: That because of the unhealthy condition existing in the City of Wichita Falls, due to not having a complete sanitary sever system, endangers the health of the citizens of said city, creates an urgent necessity demanding and requiring that the provisions of the city charter providing for the reading of ordinances on three separate days and providing that ordinances shall not go into effect until thirty days after passage, be sus- pended, and the same are hereby suspended, and this ordinance is passed as an emergency measure and shall take effect and be in force from and after its passage, and it is so ordained. to TV PASSED AND APPROVED, this the Sr* day of May, A.
