AN ORDINANCE GRANTING THE FT. WORTH &
DENVER RAILROAD COIi'ANY, ITS SUCCESSORS,
ASSIGNS ,ND LESSEES, THE RIGHT TO CON-
STRUCT A STANDARD GAUGE SIDE TRACY Al
LONG NORTH INDIANA STREET IN THE CITY
OF 171ICHITA FALLS, TEXAS.
Be it ordained by the Board of Aldermen, of
the City of Wichita. Falls, Texas:
Section 1. That the right and permission is
hereby granted the Ft. North & Denver Railroad Company,
its successors, assigns and lessees, to enter in and
along north Indiana Street in the City of Wichita Falls,
and to construct and lay a standard gauge side track,
on and along North Indiana Street, beginning at the
intersection of North Indiana Street and the Ft. Worth
& Denver right of way, thence along the west side of
North Indiana Street at north line of wichita Street,
in the manner as shown by the blueprint hereto attached.
The said track being designated on the blueprint in red,
the said blueprint bein-g attached hereto and made a part
hereof.
Section 2. The right and permission is hereby
further granted the Ft. Worth & Denver Railroad Company,
its successors, assigns and lessees, to operate trains,
engines and cars in and upon the track so constructed,
and to use same as a side track, and for all other
purposes for which said side track may be needed.

purposes for which said side track may be needed.
Section 3, Be it further ordained that the
right and permission is hereby granted the Ft. Worth
& Denver Railroad Company, its successors, assigns
and lessees, subject to the following conditions, to -
wit:
(a) The said Pt. Worth & Denver T?ailroad
Company, its successors, assigns and lessees, shall
hold the City of Wichita Falls harmless from any and
all claims for damages, whether for personal injury
to persons, or damages to property, arising by reason
of the construction of said side track, and by reason
of the operation of cars and trains thereupon.
(b) The Ft. Worth & Denver Railroad Company,
its successors, assigns and lessees, shall construct
and maintain all necessary crossings across said
street under the supervision and direction of the Board
of Aldermen of the City of Wichita Falls. Texas, and
it is so ordained.
