ORDINANCE REZONING 1700 STATE HIGHWAY 79, BEING 0.86
ACRES OUT OF BLOCK 5, HIGHLAND VILLAGE SUBDIVISION FROM
MULTIFAMILY RESIDENTIAL TO GENERAL COMMERCIAL
CONDITIONED ZONING DISTRICT AND AMENDING THE
COMPREHENSIVE PLAN; FINDING AND DETERMINING THAT THE
MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO
THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Planning and Zoning Commission recommended rezoning 1700
State Highway 79, being 0.86 acres out of Block 5, Highland Village Subdivision from
Multifamily Residential to General Commercial Conditioned Zoning; and
WHEREAS, the Planning and Zoning Commission recommended amending the
Land Use Plan, an element of the Comprehensive Plan, to conform to this rezoning;
and
WHEREAS, the City Council deems that the proposed rezoning of the area
hereafter described, and amending the Comprehensive Plan to reflect this change will
be in the public interest.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The City of Wichita Falls Land Use Plan, an element of the
Comprehensive Plan for the City of Wichita Falls, Texas is hereby amended for
rezoning 1700 State Highway 79, being 0.86 acres out of Block 5, Highland Village
Subdivision, Wichita Falls, Texas. Said property is shown on the attached map
incorporated in this ordinance as Attachment "A." The property land use designation
shall be changed from High- Density Residential to Commercial.
SECTION 2. Said property being the same as described in Section 1, is hereby
zoned General Commercial Conditioned zoning, and regulated as follows:
GC(C) GENERAL COMMERCIAL DISTRICT

Purpose
The purpose of the GC(C) General Commercial district is to accommodate commercial
activities of a retail and service nature. The uses permitted in this conditioned zone
shall encourage uses compatible with adjacent multifamily development.
Permitted Uses
A. The following uses are permitted in the GC(C) district:

- Dwelling, Duplex Two Family
- Dwelling, Single Family Detached
- Group Home
- Personal Care Home
B. The following uses are permitted in the GC(C) district subject to the Site Plan
Review provisions of Section 7100.

- Bed & Breakfast Homestay
- Boarding House
- Condominium Residential
- Dwelling, Multi - Family
- Dwelling, Zero Lot -Line Single Family, Subject to the provisions of
Section 5200
- Fraternity & Sorority House
- Townhouse, subject to the provisions of Section 5300
Civic Uses:
- Cemetery
- College & University
- Convalescent Services
- Day Care Centers, Limited & Commercial
- Library, Public
- Parks
- Public Safety Services
- Religious Assembly
- Residential Care Facility
- School, Primary and Secondary
- Utility Service
Commercial Uses:
- Alcoholic Beverage Sales, subject to the provisions of Section 5400
- Automotive Sales & Service
- Business & Trade Schools
- Car Wash
- Clinic

Development Regulations
The development regulations shall be the same as Section 3490 of the Zoning
Ordinance.
SECTION 3. Land uses shown underlined are herein underlined for the purpose
of providing emphasis and description for the purpose of this ordinance and shall not be
underlined following its passage.
SECTION 4. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
