Section one of Ordinance No. 372 passed and ap proven by the Board of Aldermen of the city of Wichita Falls, Texas, June 5th, 1921 shall be amended to read hereafter as follows, towit: It shall be the duty of every owner, agent, lessee, tenant or occupant of any house, building, flat, apartment or tenement in the city of V,,ichita Falls, Texas, where persons reside board or lodge or where any animal or ve--retable food is prepared. or served or any private residence to provide for such house, building, flat, apartment or tenement, and at all times to maintain in good order and repair a separate vessel or vessels for rubbish and mis- cellaneous waste of the materiac struction,and capacity pre- scribed as follows: For garbagel bea/metal or metal lined vessel with a close fitting top and shall b; water tight, size &t-`- not less than five gallons nor more than ten gallons. For rubbish and miscellaneous waste, a box baL-rel, or other suitable container with close fitting top, of any convenient size. All garbage and trash when being moved away shall at all times be covered with a heavy sheet enroute from place received to point of destination. All vehicles used for moving trash or garbage within the jurisdiction of the city of 7Wichita Falls shall have a solid bed, and shall be approved by the Health Officer of said city. Section Two. Any ,person violating the above provision of this ordinance shall upon conviction inncorporation court of ichita Falls, Texas, be fined in any sum not to exceed Two Hun:'_red Dollars. Section Three. The fact that th--,re is no adequate ordinance governing the hauling of trash and garbage over the streets and highways of the city of Wichita Falls, thereby endangering the health of the Citizens thereof, creates an urgency and emergency, and this ordinance is hereby declared to be an emergency measure and shall be passed as such, and it is so ordained.
