ORDINANCE CANVASSING THE RETURNS OF THE MUNICIPAL
GENERAL AND SPECIAL ELECTION HELD IN THE CITY OF WICHITA
FALLS, TEXAS ON MAY 6, 2000: FINDING AND DETERMINING THAT
THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW
WHEREAS, the Mayor and City Council of the City of Wichita Falls have
heretofore called for a general /special election to be held in said City on May 6, 2000 to
elect a Mayor, Councilor District 3, Councilor District 4, Councilor District 5, and to vote
on a proposition on the sale of surplus park property in Weeks Park; and
WHEREAS, the election officers who held said election have duly made the
returns of the result thereof, and said returns have been duly delivered to said City
Council, and
WHEREAS, it is hereby officially found and determined that the meeting at which
this Ordinance was passed was open to the public, and public notice of the time, place
and purpose of said meeting was given, all as required by Chapter 551 of the Texas
Government Code, and
WHEREAS, after canvassing the returns of said election, it was found to be duly
and legally held in all respects, and that 7200 voters voted in said election, and that
votes were cast as follows:

received 3574 votes.

Shall the City be authorized to sell at fair market value, surplus park property in
Weeks Park, said property being described as a 1.47, more or less, acre tract of land
located in the J.A. Scott Survey, A -294, a tract of land in the City of Wichita Falls,
Wichita County, Texas:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WICHITA FALLS, TEXAS, THAT:
SECTION 1. Said election was in all respects legally held in accordance with the
laws of the State of Texas and the Charter and the Ordinances of the City of Wichita
Falls.
SECTION 2. The City Council officially finds, determines and declares the results
of said election to be that Jerry Lueck was duly and legally elected Mayor; Bill Altman
was duly and legally elected Councilor District 3, Johnny Burns was duly and legally
elected Councilor District 4, and that Harold Hawkins was duly and legally election
Councilor District 5, and that Proposition regarding sale of surplus park property in
Weeks Park has received a favorable /unfavorable majority vote in all respects and
has /has not carried.
SECTION 3. It is hereby officially found and determined that the meeting at
which this Ordinance was passed was open to the public as required by law.
