ORDINANCE WAIVING PENALTIES AND INTEREST FOR
DELINQUENT TAXES ASSESSED AGAINST PROPERTY OWNED BY
MR. LEON FLAKE; FINDING AND DETERMINING THAT THE MEETING
AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE
PUBLIC AS REQUIRED BY LAW.
WHEREAS, Section 33.011 of the Texas Property Tax Code provides that
penalties and interest on delinquent taxes may be waived by the taxing unit if the failure
to timely pay the required taxes was due to an act or omission of an officer, employee
or agent of the taxing unit or the appraisal district and if the tax is paid within 21 days
after the taxpayer knows or should know of the delinquency; and
WHEREAS, the City Council finds that the circumstances involved in this
situation are exceptional and that the above described waiver should be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. A waiver of the City's portion of the penalties and interest on
delinquent taxes for property owned by Mr. Leon Flake in the amount of $99.74 is
hereby approved.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
