AND IT IS Tr.,, .FBY OTIDtMITED BY TlE BOARD OF .ALDV..yYN OF TRE CITY OF WMTITA FALLS, T'JA Ti 'NES.} E.A.S, the City of wichita Falls has heretofore by resolution declared tl,e necessity of largmuinE by pavin: , T ,Tlor Street, from. the North Curb line of Avenue M to t?ie Borth iaro-)erty line of the Wichita Valley Railway Company right of way in the said city, which resolution is dated AlDril 26, 1926, and the various forms, reports, specifications and resolutions with regard there- to, have been duly had and passed by this board, and the contract for -caving said project, has -been duly-awardad in open meeting, to L. E. Whi'th.vt & Company, according to gpooifimati.om of the City En 4inesr, dull fileedi and WTME;AS, by resolution passed JUM 14th, 1926, after receiving the report of the Engineer as to the cost of said improvement, a public hearing to property owners was duly granted, ordered and held, and at said hearing, which was held in the council chamber of said Board, on February 7th, 1927, it was brought to the attention of this Board that it is impracticable and almost impossible to legally proceed with paving, a portion of said ori4inally described project on said street, due to the protests of various property owners, whose property abuts a portion of said street, and their inability to finance said improvement and secure said contractor f�-)r their prorata part of the cost thereof, which portion of said street is deesoribeed as being Taylor Street, bee» tween Avenue 0. and. t1ne Wic')ita Valley Railway Company Rir7h.t of wad', and wroYA$, the owners of property on Taylor Street between, Avenue! M and Avenue q, being present at the public hearing accorded them, as well as the owners of property on that portion of said street last above set Horth were presents and said owners of property between .Avenue M and Avenue 0. on said street are desirous of proceeding with the pavement of said latter portion of said streat sit this time-, .regardiess of whether Tay�qr Street between Avenue M and 'the Wichita Vil.leq RAII* COMP. aAy ri»kht° of way to paved at this time or not,. bt being determined that from a report of the Oitlr Engineer filed, harew.ith, that no material changes in the cost per front foot or cost of curb shall be effected, and whenever a chane is shown on said report in the cost of paving, excavating, grading or curbs, said chane in no place shows do increase in the cost of such portion of said Improvements anti. in all cases-*berf-fn a change, however small, is noteed, such change in cost results in a decrease in the cost of said ravin..3 improvements and a saving to said property owners. I. NOW, THEREFORE, it is hereby ordered and resolve3d, by the Board of Aldermen as aforesaidt That by reason of the'facts developed at said hearing accorded said property owners, with reference to paving said portion of Taylor Street, from, the north curb line of Avenue M, to the South property line of the Wichita Valley Railway Cow-pany right of way, in said city, it is deemed advisable, and saline is hereby ordeared,to cha,n,Fe3 the original bounds of the paving of said street from Avenue M to the Wichita Valley Railway Compan:r right .of way to Taylor Street, from Avenue M, to Avenue Q. and that by such action that portion. of Taylor Street 'betweevn Avenue G�, and t'�e Widbita Valley Railway Company. right of way is hereby, released, and ' omitted ,from the original paving bounds and limits of said project, and th-.t all matters anti things be uow proceeded with, as required by law and by the Charter of the City of Wichita Falls, to pave that portion of Taylor Street between the north. curb line of AvenvB Mp and Avenue q, which latter boundary is described as beim Lot 7, block 16-A, Highland Addition to the Cite of Wichita Falls, Wichita County, Texas, in said city. 2. As a direct result of the aforementioned public hearing and by the agreement had between said property owners, said contraotar and said city, in open meeting, the bounds of said original prole©t are hereby changed as above ret forth, and the report of the City Engineer filed here- with is hereby expressly made a part hereof, and made the basis of the ordinance to be passed, assessing; the benefited property abutting said portion of said street to be pavedl it being farther ordered that the hearing to property owners be now olosed, and that an ordinance issued ordering; the Improvement of said portion of said street, and that the necessary contracts and subcontracts be prepared and duly inspected for approval by said Board. 3. The fact that the improvements herein mentioned ire being delayed pending the effect of tris ordinance, and thea the condition of said portion of street endangers the publics health and safetvv constitutes and creates an urgent public necessity requirin«; that they rules providing that ordinanOss be read at more than one meeting; and for more than one time be suspended, and requiring that this ordinance be passed and take effect a$ an emerje.,cy amep-sure, and such rules are accordingly suspended, and vols ordinance is passed as an emergency measure, and shall be in force and effect irm;ediately from and after its passage, That this ordinance shall take effect from and after its passage.
