ORDINANCE CLOSING, VACATING, AND ABANDONING A 20 FOOT X
139 FOOT ALLEY LOCATED AT 1620 12T" STREET, BETWEEN ALMA
AND GRACE STREETS, WITH FRONTAGE ON 12T" STREET; ALSO
KNOWN AS LOT 17 -A, BLOCK 263, CANFIELD SUBDIVISION; FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, property owners have requested the closure of a portion of an alley
located at 1620 12" Street for the purpose of expanding their warehouse; and
WHEREAS, all affected utility companies have been contacted and have
approved or conditionally approved of this closure; and
WHEREAS, the City Council of the City of Wichita Falls, Texas deems it
advisable and in the public interest to close, vacate and abandon that portion of the
alley hereinafter described subject to the filing of a final replat of the abutting property
within six months of the date of this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. That portion of a 20 -foot wide alley adjacent to the east line of Lot
17 -A, dedicated on the plat of Lots 1 -A & 17 -A, Block 263, Canfield Subdivision, an
addition to the City of Wichita Falls, as recorded in volume 25, page 318, Wichita
County Plat Records, is hereby closed, abandoned and vacated. Said alley is shown
as the shaded area on the attached map, incorporated in this ordinance as Attachment
"A."
SECTION 2. That in consideration of the receipt of Five Thousand Five
Hundred Sixty Dollars, this ordinance shall authorize the Mayor to execute a quit claim
deed for the City's interest in the property. The deed shall be executed conditioned
upon the property owners filing an approved replat of the property in the records of the
Wichita County Clerk. This filing shall occur within six months of the date of approval of
this ordinance. This ordinance shall be void and have no effect if said replat is not
approved and filed within the stipulated time period.
SECTION 3. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
