ORDINANCE WAIVING SECTION 27 -29 OF THE MUNICIPAL CODE;
FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS
ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS
REQUIRED BY LAW.
WHEREAS, Section 27 -29 (c) requires the construction or escrowing of funds for
sidewalks on all abounding streets if a commercial building is to be constructed; and
WHEREAS, the property owner at 5019 Bonny Drive has requested a waiver of
the sidewalk construction and /or escrowing requirement.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. Section 27 -29 (c) of the Municipal Code is waived as it relates to
commercial construction on 5019 Bonny Drive (Lot 1 -13 of Melody Ranch Estates) as
follows:
a) Sidewalks on Deer Creek Road adjacent to 5019 Bonny Drive is hereby
waived.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
