BE IT ORDAINED BY THE BOARD F ALDEIRMEIIf OF THE CITY nF WICHITA FALLS, TEXAS: SECTION 1: That it shall be a nuisance for any person, firm or corporation to store, keep or have calcium carbide in any building within the corporate limits of "Vichita Falls, un- less said.person, firm or corporation shall have first pro- cured a license or permit from the City 'Manager of the City so to do; provided, hoer,,ever, that any person, firm or corporation may store, keep or have an amount of calcium carbide not exceed- ing one hundred pounds in any building within the corporate lim- its of this city without said license or permit if the same shall be stored in a strong water -tight metal receptable holding not exceeding 50 two pound cans, or 20 five pound cans, or lo ten in pound cans, said receptacles tobwaterproofaandewelldventalated; storage places which ay� and also provided thv.t call but one of the packages of each size of carbide shall be sealed and the seal shall not be broken so long as there is carbide in excess of one pound in any other unsealed package in the building. Such storage place shall be in the generator room and not elsewhere unless a more suitable place can be provided. The license or permit above mentioned shall be granted by the City Manager upon sworn application in writing, stating the place or building in wri ch the applicant desires to store or keep or have calcium carbide, with a full description of the manner in which he desires to store, keep or have the same. If kept, stored or had in quantities less than 6UO pounds, under license or per- mit, it shall. be stored, kept or had in strong, water -tight metal cans containing; not exceeding JOU pounds each. No license shall be granted. until the Fire Marshall shall have bertified_.t0 1th6 -City Managet' that he -has- examined, the promises upon which the applicant desires to store, keep or have calcium car- bide, and that the building where it is desired_ to keep, Have or store same is of good construction, water -proof, well drained and ventilated, and that the calcium carbide will be stored above grade. SECTION 2: Calcium carbide in excess of six hundred (600) pounds shall be stored in approved metal packages above ground in one-story buildings without cellar or basement and used exclusively for the storage of calcium carbide, unless in a specially constructed outside generator house. Storage buildings shall be constructed, to be dry, waterproof and well ventilated and shall be located out- side congested mercantile or manufacturing districts. If storage building is of incombustible construction, it may adjoin other one-story buildings if separated therefrom by an unpierced fire wall; if detached less than ten feet fro :� such one-story buildings, there shall be no openings in the adjacent sides of either building. If the storage building is of combustible construction, it must not be within twenty feet of other one-story or two-story buildings, not within thirty feet of other buildings over two stories. Falls for com- mercial purposes or in any public automobile garage shall make a written report of such fact to the Fire ?,Marshall, stating the street number of the building and. where the said calcium carbide is kept therein. A failure to mare such report or the keeping or having on hand_ of any calcium carbide in any public automo- bile garage or' in any building for commercial purposes without said report having been made shall be a violation of this ordi- nance.' SECTION 4: The st'oring,ax keeping or having of calcium carbide contrary t•o, any of the provisions of this ordinance or not in accordance with the terms and provisions hereof,shallin be, and constitute, a ,nuisance Wand the' offender or any person anywise interested in storing, keeping or having same, shall upon conviction before the Corporation Court, be fined in any sum not less than Five Dollars and not more than One Htnorehed lla're, and each and every, day , thaat� same is so stored, kpp in violation of the terms hereof or cont°racy to the terms and pro- visions hereof,; shall be and constitute a separate offense, sub- jecting the offender to a like-Qena.lty.
