SECTTOT 1; That the right and permission is hereby
granted to the Adams Electrified L; Distilled ?Water Company, s
corporation, its successors, assigns and lessees, to enter
upon, in and along 'Railroad Street between the alley inter-
secting Plock 3, Spivey Addition, and Holliday Street in the
City of '.!.Iichita Falls, 77ichita County, Texas, and to construct
and operate therein a loading rack to serve its plants located
on I-ot 1, Block 3, Spivey Addition.
SECTION 2 : HE IT T,T?RT-rEP OPDAII`ED TTAT the said
right and permission is hereby granted to the Adams Electri-
fied ep Distilled ,';rater Company, its successors, assigns and
lessees, subject to the following conditions:
(a) That the Adams Electrified & Distilled Tliter Com-
pany, its successors, assigns and lessees, s rnll hold the
City of 17ichita Falls , Texas, harmless from any and all com-
plaints for damages either for injury to persons or damages
to property arising by reason of the onstruction of said
loading rack in said street or from use of said
loading rack placed in said street .
(b) The said Adams Electrified &, Distilled later Com-
pany, its successors, assigns and lessees, shall maintain
and keep sEid loading rack in repair, and construct all
necessary drains under and along said rack and shall keep
that Dart of the street occupied by said loading rack in
repair, and in the event said street shall be ordered
paved the said "..dams Electrified and Distilled "'a.ter Company
shall pay for the paving of said street occupied by said
loading rack.
