D MAI?�I�rAIN A STANDARD GAUGE SIDE RAIL7AY TRACK UPON AND ACROSS NORTH BORAYRAY STREET IN THE CITY OF 01ICHITA FALLS , WICHITA COUNTY, TEXAS : BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CI`l'Y OF WICHITA FALLS , TEXAS : SECTION 1 : That the right and permission is hereby granted by the city of Wichita Falls , Texas , to the Fort Worth and Denver City Rail�:,ay Company, its successors , assigns , and lessees , to enter upon in and along North Broadway Stree in tree city of Wichita Falls, Texas , and to ep struct , . y and maintain a standard gauge side trac' /upon, in, and along the said North Broadway Street as is indicated in the blue print attached hereto and made a part hereof , marked "Exhibit All , showing in green, yellow, and red the location of the proposed side track and where the same crosses said North Broadway Street. SECTION 2 : The right and permission is hereby further granted to the said Fort Worth and Denver City lailway Company, its successors , assigns, and lessees, to operate trains , engines , and cars in, upon, and over the track so constructed and maintained , and to use the same as a side track and for any and all other and further purposes for which said side track may be needed. SECTION 3: Be it further ordained that the said Fort Worth and Denver City Railway Company shall have the right in so constructing said railway side track to remove such por- tions of the concrete pavement in said North Broadway Street as is reasonably necessary for the construction and maintenance of this said side track , but they shall each time and in each instance replace the said concrete excepting over the rails of said track, with what is commonly known as "One-Two-Three mixture of cement sand and gravel concrete" seven inches thick, adequately reinforced , eighteen fret wide so as to conform substantially with the concrete now =GTION J34 The X�� the Fort Worth and benver City Railway Company,its sueeesors,assigns and lessees,shall hold the C City of Wichita F&118,Texas,ha,rmless from any and all claims for damages,whether for personal injury to persons,or damage to property,arising by reason of the construction of said side track and by reason of the operation of cars and trains thereon.
