liN ORDINANCE REGULATING WATER SUPPLIES tiJITHIN THE CITY OF
VICHITA FALLS, TE�:AS, PROVIDI_ G FOR A PERMIT B ,FORE ENGAGING IN
THE BUSINESS OF SUPPLYING 'DATER TO THE CITIZENS OF WICHITA FALLS,
PROVIDING FOR TH TESTING OF WATER AND WATER SUPPLIES i=�t�TD PRE-
SCRIBING THE PENALTY, LND DECLARING AN E11ERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDERM�N OF THE CITY OF

SECTION 1.
Any person, firm, association, or corporation to operate
any water supply within the City of Wichita Falls, Texas, from
which water is sold to others through pipinS, in bottles, or
otherwise shall make application in writing to the Department
of Health and Sanitation upon prescribed forms for a permit to
do business in the City of Wichita 2alls. When such water sup-
ply has been inspected by the Director of Health and Sanitation
or his assistant and has been found to comply with the ordi-
nances of the City of Wichita Falls and the rules and regula-
tions of Department of Health and Sanitation covering same, said
Director shall issue a permit on a form prescribed by himself.
Such permit shall be renewed annually.
SECTION 2.
All persons, firms, or corporations ovming or operating
water supplies from which water is sold in bottles , which water
is bottled in the City of Wichita Falls, shall equip its bottl-
ing plant so as to comply with the rules and regulations of the
Health and Sanitary Department, so as to avoid contamination in
bottling such .water.
S.:AC T ION 3.
No dry toilet, septic tank, cesspool, unsanitary cow
lot, horse lot, hog pen, or any collection of filth, garbage,
or any other filthy thing or substance shall be permitted with-
in two hundred (200) feet of any such well or water supply or
water bottling plant or farther if it is evident that pollution
is reaching such well or other water supply froth a source far-
ther away than the distance mentioned above.
SECTION 4.
All water sold dnd distributed from any water supply,
whether produced within the city limits of the City of Wichita
Falls or whether shipped into said city, shall meet the require-
ments of the United States Treasury Department standards as ap-
plied to the interstate use of waters.
SECTION 5.
The Director of the Department of Health and Sanitation
or his assistant shall at regular intervals take samples of
water from any webs, bottle4 tank, or other receptacles that
may be used in such water supply; and where such samples do
not, from analysis, meet the requirements as to bacterial count
and chemical content of the United States Treasury Department
standards as applied to the interstate use of water; he shall
cause such water to be disposed of in such a manner as not to
be used for domestic purposes .within the City of Wichita Falls.

SECTioy 6.
Inspections and analyses of samples of water supplies shall
be taken and made by the Department of Health and Sanitation at
such intervals as will assure the supplying of pure grater and
protect the health of persons using such water supply.
SECTION 7.
Any person, firm, or corporation who shall engage in the
business of supplying water to the public without first having
procured a permit shall, upon conviction in the Corporate Court,
be fined in any sum not less, than Ten Dollars (410.00) and not
more than Two hundred Dollars (y'200.00) and each and every day
such person, firm, or corporation shall so engage in business
without a permit, shall be a separate offense ; any person, firm,
or corporation violating any other provisions of this ordinance
or any of the rules and regulations prescribed by the Department
of Health and Sanitation under this ordinance, shall, upon con-
viction, be fined any sum not to exceed Two Hundred Dollars
($200.00) .
SECTION 8.
The fact that there is no ordinance regulating water sup-
piies and the sale of water within the corporate limits of the
City of 'Wichita Falls, the further fact that water is being
shipped into the City of Wichita Falls , and supplied fron-, other
sources which might be subject to contamination and affect the
health of the citizens of Wichita Falls, creates an emergency;
and this ordinance is declared an emergency measure and the rule
requiring the reading of ordinances on three (3) several days
is hereby suspended and this ordinance shall take effect from
and after its passage and approval.
