Ord 002-2001 1/2/2001ORDINANCE NO. ORDINANCE REZONING APPROXIMATELY 10 ACRES OUT OF THE J. R. MCDOWELL SURVEY, ABSTRACT 194, FROM SINGLE FAMILY -1 AND SINGLE FAMILY -2 TO MULTIFAMILY RESIDENTIAL ZONING AND AMENDING THE COMPREHENSIVE LAND USE PLAN; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the Planning and Zoning Commission recommended rezoning approximately 10 acres out of the J. R. McDowell Survey, Abstract 194, from Single Family -1 and Single Family -2 to Multifamily Residential Zoning; and WHEREAS, the Planning and Zoning Commission acknowledged that conditions in the proposed area have changed and recommended amending the Comprehensive Land Use Plan, an element of the Comprehensive Plan, to conform to this rezoning; and WHEREAS, the City Council of the City of Wichita Falls, Texas, deems that the proposed rezoning of the area hereafter described, and amending the Comprehensive Plan to reflect this change, will be in the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. The Land Use Plan, an element of the Comprehensive Plan for the City of Wichita Falls, Texas is hereby amended for a tract of land being described as approximately 10 acres out of the J. R. McDowell Survey, Abstract 194. Said property is shown on the attached map, incorporated in this ordinance as Attachments "A" and "B." Said property land use designation in the Comprehensive Plan shall be changed from Low Density Residential to High Density Residential. SECTION 2. Said property being the same as described in Section 1 of this ordinance is hereby rezoned from Single Family -1 and Single Family -2 to Multifamily Zoning. SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law. McDowell Survey, A -194, which bears S 89° 08'00" E a distance of 501.68 feet from its Northwest corner, and being the Northeast comer of a 11.50 acre tract conveyed to United Affordable Housing, L.P., by warranty deed recorded in Volume 2205, Page 711 of the Wichita County Deed Records; THENCE S 890 08'00" E with the North line of the J. R. McDowell Survey in the right -of- way of Rathgeber Road a distance of 474.00 feet to an iron rod set for the Northeast corner of this tract; THENCE S 000 52' 00" W a distance of 920.46 feet to an iron rod set for the Southeast corner of this tract; THENCE N 870 52'06" W a distance of 474.12 feet to an iron rod set in the East line of said 11.50 acre tract for the Southwest comer of this tract; THENCE N 000 52'00" E with the East line of said 11.50 acre tract a distance of 910.00 feet to the PLACE OF BEGINNING and containing 9.959 acres of land.
