Ord 031-2001 4/3/2001ORDINANCE NO. 3i ICoj ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, CLOSING AND ABANDONING A PORTION OF BLUFF STREET BETWEEN EIGHTH AND NINTH STREETS; FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW. WHEREAS, the First Baptist Church of Wichita Falls, Texas, has asked for the closure of that portion of Bluff Street located between Eighth Street and Ninth Street; and, WHEREAS, the City Council of the City of Wichita Falls deems it advisable and in the public interest to close, vacate and abandon that portion of Bluff Street located between Eighth and Ninth Streets, Wichita Falls, Texas. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WICHITA FALLS, TEXAS, THAT: SECTION 1. That portion of Bluff Street, which is shown as the cross - hatched area on the attached map, incorporated in this ordinance as Attachment "A" and further described as follows: that one block section of Bluff Street, an 80 foot wide right -of -way running northwest or southeast parallel to Burnett and Broad Streets, being approximately 350 feet in length extending from the north line of Ninth Street to the south line of Eighth Street, bounded on the east by Lot 1 -A, Block 170, and bounded on the west by Lot 2 -A, Block 236, Original Townsite of the City of Wichita Falls, is hereby closed, vacated and abandoned. SECTION 2. In consideration of the receipt of Fifty Six Thousand ($56,000.00) Dollars and other related costs as shown on Attachment "B," this ordinance shall authorize the Mayor to execute a quitclaim deed for the City's interest in the property. SECTION 3. It is hereby officially found and determined that the meeting at which this ordinance was passed was open to the public as required by law. P-0 Attachment B Other Costs Related To Passage Of An Ordinance Of The City Council Of The City Of Wichita Falls, Texas, Closing And Abandoning A Portion Of Bluff Street Between Eighth And Ninth Streets Relocation of City of Wichita Falls Utilities $_20,000 Relocation of other public utilities authorized to be in said $ right -of -way Traffic engineering and construction of appropriate street markings and signalization related to conversion of 8th Street from existing one -way to two -way, subject to the right of the Church to petition for refund in the event the met costs are less than $158,907 $_158,907 Total Other Costs: $ 178,907 ( • Wichita Office of the City Manager (940)761-7404 November 12, 2003 Dr. Robert Jeffress First Baptist Church 1200 Ninth Street Wichita Falls, Texas 76301 Re: Street Closure Dear Dr. Jeffress: This letter is provided to confirm the City's understanding and agreement regarding the closure of Bluff Street between Eighth and Nine Streets. You will recall in April 2001, the City Council authorized the closure of the street upon the Church's payment to the City for the value of the right-of-way plus additional costs for utility relocation and traffic signalization and signage. The Church thereafter paid the City $56,000 for the value of the right-of-way. The City is prepared to move forward with the closure based upon the following understanding: 1. The Church will pay the City $20,000 for the costs incurred by the City in the relocation of utilities currently located in the right-of-way. The Church has tendered payment for this cost. 2. The Church will pay the City up to $49,340 for costs to be incurred by the City in the conversion of Eighth Street to two-way traffic. This amount will be paid upon your receipt of our invoice reflecting the amount actually incurred (not to exceed $49,340.00). 3. In addition to the costs identified above, it is possible the City may incur additional costs for traffic signalization and signage at the intersections of Eighth and Bluff and Eighth and Brook Streets. At this point, it is difficult to determine what, if any, of this work will be needed. The Church will agree to pay the City for costs incurred in the event such work is needed with the following limitations: 1300 7th Street P.O. Upon the Church's completion of its new worship center and the issuance of a Certificate of Occupancy by the City, the City shall have 12 months to determine the necessity for the additional work and the estimated cost to complete same. The City will determine the need for the work using the guidelines of the Texas and Federal Manuals on Uniform Traffic Control Devices. The City will furnish the Church with a copy of the estimates for this work and the Church will tender funds to pay for the work up to the cap of$75,243.07. Please indicate your approval of these terms by signature below and return to our office. The City is prepared to execute a quitclaim deed to the Church for the Bluff right-of-way.
