AN ORDINANCE WAIVING MOWING LIENS, CLEANING LIENS,
INTEREST, AND DELINQUENT TAXES FOR 906 GERALD AND 910
GERALD, W. E. WILSON ACRES ADDITION, CONTINGENT UPON
HABITAT FOR HUMANITY'S ACQUISITION OF SAID PROPERTY FOR
THE CONSTRUCTION OF RESIDENTIAL HOMES UNDER THE CDBG
HOUSING INITIATIVE PROGRAM; FINDING AND DETERMINING THAT
THE MEETING AT WHICH THIS ORDINANCE WAS PASSED WAS
OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, Habitat for Humanity has expressed an interest in purchasing 906
Gerald and 910 Gerald from the current owner and constructing residential homes on
these lots under the CDBG Housing Initiative Program; and
WHEREAS, the owner of these lots has agreed to deed ownership of these lots
to Habitat for Humanity for such construction; and
WHEREAS, these lots have accrued a substantial amount of mowing liens,
cleaning liens, interest, and delinquent taxes over a 21 -year period; and
WHEREAS, Habitat for Humanity has requested a waiver of these fees on the
two lots; and
WHEREAS, Habitat for Humanity, upon conveyance of the property at 906 and
910 Gerald to it by Progressive Baptist Church, and contingent upon the City's waiver of
the existing mowing liens, cleaning liens, delinquent taxes and interest on these lots,
agrees to (1) pay the current tax - appraised value of the properties, (2) re -plat the two
properties and (3) purchase the necessary building permit(s).
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS, THAT:
SECTION 1. The existing mowing liens, cleaning liens, delinquent taxes and
interest against TR 4 & 5, Block 6, W.E. Wilson Acres, a /k/a 906 Gerald, and 47.3' x
139.8' of Block 7, W.E. Wilson Acres, a /k/a 910 Gerald, shall be waived, contingent
upon Habitat for Humanity's acquisition of said property; and further contingent upon
Habitat for Humanity paying the current tax appraised value of the two properties, re-
platting same, and purchasing the necessary building permits to construct residential
homes on these lots under the CDBG Housing Initiative Program.
SECTION 2. It is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
