AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WICHITA
FALLS, TEXAS, AMENDING CHAPTER 29, ARTICLE VIII, DIVISION 2,
"TRAFFIC SAFETY COMMISSION" OF THE CODE OF ORDINANCES BY
CHANGING THE COMMISSION'S MEMBERSHIP COMPOSITION AND
REWORDING SOME OF THE LANGUAGE OF THE ORDINANCE TO
REFLECT THE RESPONSIBILITIES /DUTIES OF THE TRAFFIC SAFETY
COMMISSION; REPEALING ALL ORDINANCES AND PROVISIONS IN
CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY; AND FINDING
AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE
WAS PASSED WAS OPEN TO THE PUBLIC AS REQUIRED BY LAW.
WHEREAS, the Wichita Falls Traffic Safety Commission helps provide for a
more efficient and effective way to improve traffic regulations and traffic safety in the
City; and,
WHEREAS, the Wichita Falls Traffic Safety Commission finds it necessary to
revise some of their operational provisions to insure that the meetings held by the
Traffic Safety Commission are more effective.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WICHITA FALLS, TEXAS:
SECTION 1. That Article VIII, Division 2, Chapter 29 of the Wichita Falls Code of
Ordinances is hereby amended at Section 29 -198 to read as follows:
"Sec. 29 -198. Membership qualifications.
, The six citizen appointees of the Commission must be citizens of the City of
Wichita Falls. In appointing the members, the City Council shall attempt to appoint
persons who meet the following qualifications:
(1) One representative of the City Traffic Engineering Division.
(2) One representative of the Traffic Division of the Wichita Falls Police
Department.
(3) The Wichita Falls Independent School District School Safety Officer.
(4) One representative of the Texas Department of Transportation.
(5) One representative of the Texas Department of Public Safety, Safety
Division.
(6) One representative of the Wichita County Sheriff's Department (Patrol).
(7) One representative of the Insurance Industry - Auto Claims Division.
(8) One representative of the School Transportation Industry.
(9) One Sheppard Air Force Base safety representative.
(10) One person who represents Municipal Court.
(11) Six citizens of the City who are interested in traffic safety; one shall be
appointed from the City at- large, and one shall be appointed from each of
the Council districts, with consideration given to the following fields of
expertise: legal, insurance industry, and transportation industry."
SECTION 2. That Article VIII, Division 2, Chapter 29 of the Wichita Falls Code of
Ordinances is hereby amended at Section 29 -202 to read as follows:
"Sec. 29 -202. Committees.
The chairman shall appoint, from among the commission members, members to
the following committees, as required:
(1) Traffic safety education committee.
(2) Recognition and awards committee.
(3) Finance committee.
(4) Public relations committee.
(5) Nominating committee."
SECTION 3. That Article VIII, Division 2, Chapter 29 of the Wichita Falls Code of
Ordinances is hereby amended at Section 29 -204 to read as follows:
"Sec. 29 -204. Powers and duties generally.
(1) It shall be the duty of the commission to review and advise upon any
recommendations of the desirability of traffic conditions for the City.
(2) It shall report and recommend to the City Council appropriations and
expenditures of the Traffic Safety Commission funds.
(3) It may recommend ordinances enhancing traffic safety.
(4) It may conduct hearings and request witnesses be subpoenaed.
(5) It may make investigations that, in the opinion of the members, would
solve traffic problems, including increased traffic flow and safety.
(6) Proposals by the traffic engineering division of the city may be subject to
the consideration of the commission before presentation to the City
Council.
(7) It may require the attendance at any commission meeting by any city
employee or official for consultation and /or advice.
(8) It may request traffic studies.
(9) It may provide training for city residents and /or violators of the traffic laws
in traffic safety.
SECTION 4. That should any section, paragraph, sentence, clause, phrase or
word of this ordinance be declared unconstitutional or invalid for any purpose, the
remainder of this ordinance shall not be affected thereby.
SECTION 5 That it is hereby officially found and determined that the meeting at
which this ordinance was passed was open to the public as required by law.
