AN ORDINANCE PROHIBITING THE DISCHARGE AND FIRING OF FIRS

CANNON CZA.CKERS OR ANY OTHER KIND OF FIRE WORKS WITHIN THE
FIRE LINTS ',WITHIN ANY PLACE OF BUSINESS, OR OTHER PLACE WHERE
PEOPLE ARE CONGREGATED FOR BUSINESS OR PLEASURE, AND UPON THE
STREETS AND PUBLIC WAYS OF THE CITY OF WICHITA FAITS; REGUL&T-
ING AND LICENSING THE BUSnT.ESS OF SEILIIvG FIRE `JORKS, R011"T
CANDLES, SKY ROCKETS, TORPEDOES, FIRE CRACKERS, CANNON CRACKERS

FALLS; PROHIBITING THE SALE OF SUCH FIRE WORKS WITHIN TIE FIRE

OF THE CITY AND IN FRONT OF AND IN OR IT AR THE ENTRANCES TO
PLACES OF BUSINESS; REQUIRING ANY PERSON, FIRM OR CORPORATION
BEFORE ENGAGING IN THE BUSINESS OF SELLING FIRE `JORKS AT RETAIL
TO APPLY TO AND PROCURE FROM THE TAX COLLECTOR OF THE CITY OF
JICHITA FAILS A LICENSE TO SO ENGAGE IN SAID BUSINESS AND PAY
THEREFOR AN ANNUAL LICENSE FEE OF TWO AND 50/100 ($2.50) DOLLARS;
I,I\TD PROVIDING THAT SUCH SALES SHALL ONLY BE M, E AT ESTABLISHED
PL'iCES 021 BUSINESS AND STORv, HOUSES AND WITHIN SUCH BUILDII"GS;
PROVIDING A PENALTY; PROVIDING THE INVALIDITY OF ANY PROVISION
OF THIS ORDINANCE SHALL NOT AFFECT THE OTTER PROVISIONS ; REPEAL-
ING ALL ORDINANCES IN CONFLICT -'ITH THIS ORDINANCE; AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF ALDLRJ��EN OF THE CITY OF
C4ICHITA FALLS, T E S:
SECTION 1.
That it shall hereafter be unlawful for any person to dis-
charge or cause to be discharged or fired within the fire limits ,
as now fixed or as may be hereafter fixed, upon any street , alley
or other public way or within any place of business, or other
place where people are congregated for business or pleasure, any
fire works , roman candles, sky rockets , torpedoes , fire crackers,
cannon crackers or any other kind or character of fire works.
SECTION 2.
That before any person, firm or corporation shall sell or offer
for sale or have in possession for sale at retail any fire works,
roman candles , sky rockets, torpedoes, fire crackers, cannon crack-
ers or any other kind or character of fire works , such person or
corporation shall mare application to the Tax Collector of the City
of 'tiichita Falls for a license to engage in such business, which
said application shall give the name of the applicant, the address
or place where such business is proposed to be carried on and shall
state that the applicant shall faithfully and fully comply with all
provisions of this Ordinance, which said application shall be ac-
companied by a license fee of Two and 50/100 2. 50 Dollars , which
shall cover a period of twelve (12) months frog-, the date said license
is issued. Upon the receipt of such application the Tax Collector,
if he is satisfied the place of business where such fire works are
to be sold complies with the provisions and requirer.ients of this
Ordinance, shall issue to the said applicant a license to engage in
such business for a period of twelve (12) months from the date of
such license.
SECTIQY 3.
That no such business shall ever be carried on and no fire
works, roman candles , sky rockets, torpedoes, fire crackers, cannon
crackers or any other kind or character of fire works shall ever
be sold at retail within the fire limits of the City of vrichita
Falls as same are now fixed or may be hereafter fixed.
SECTION 4.
That such business shall not be conducted upon any street,
alley or other public way of the City and no fire works , roman
candles, sky rockets, torpedoes, fire crackers, cannon crackers
or any other kind or character of fire works shall be sold or
offerred for sale upon the streets , alleys or other public ways in
the City of �',Y'ichita Falls and that the license issued hereunder
shall only authorize the sale of such fire works in and at places
of business which have been established and in existence for at
least three (3) months prior to the date of the application for such

license ; such sales not to be made in front of , in or near the en-
trance of such buildings but only in the buildings proper at at
least ten (10) feet away from such entrances.
SECTION 5.
That if any provisions of this Ordinance shall be declared
void for any reason, it shall not affect the other provisions of
this Ordinance but same shall remain in full force and effect.
SECTION 6.
Any person, firm or corporation violating the provisions
of this Ordinance shall upon conviction be fined any sum not less
than Five ( +5.00) .Dollars nor more than Two Hundred (9`200.00 ) Dol-
lars. Each and every discharge of fire works and each and every
sale of fire works prohibited under this Ordinance shall constitute
a separate offense.
SECTION 7.
All Ordinances and parts of Crdina,nces in conflict here-
