AN ORDINANCE REGULATIN3 AND REQUIRING TRANS SHOWS TO HAVE LICENSE TO OPERATE AND FIXING LICENSE FEE9 DEFINING TRANSIT SHOWS, PROVID ING A PENALTY I.VHERELS, transit shows have been held in the City of Wichita Falls every few months and have often resulted in large crowds congre- gating and engaging in unlawful conduct and in the victimizing of many persons, requiring extra policement and police regulation; end 114HEREAS, there is now no law regulating the licensing and controling of transit shows, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF AIDERKEN OF THE CITY OF 71ICHITA FALLS9 TEXAS: SECTION 1. It shall be unlawful to hereafter holds sponsors operate or run a transit show in the City of Wichita Falls unless a permit to hold such transit show is first obtained from the City Of Wichita Falls, in accordance with this ordinance. Each person aiding or abating in the holding of such transit show or its subsidiary shows, concessions, amusements$ and business shall be equally guilty of a violation of this article when said transit show operates or runs with- out such permit. A permit shall be issued by order of the Board of Aldermen to hold such transit show when and only when a proper application in writ- ing ismade therefore Such application shall state in detail the differ!.- ent components parts of the transit shows including all concessionss shows, amusementeg business and the proposed location of said transit show; the time it is to run, the number of persons regularly traveling therewith, if any, and the number of local persons connected therewith and shall give a complete and full plan of the proposed transit show, If the prcposed transit show appears to be entirely composed of lawful amusements and la.wful enterprisesq the Board of Aldermen shall determine the number of extra police necessary to properly super- intend such transit show,, and regulate the anticipated crowds attending such transit show. The Board of Aldermen shall instruct the assessor and collector of taxes how many such extra officers shall be needed and whether to issue such permits, SECTION 2. The applicant for permit, if the Board of Aldermen shall determine that said permit shall be issued, shall then pay a license fee of Fifty ($50.00) Dollars, together with Ten ($10.00) Dol- lars per day for so many days that said transit show is issued a permit to run and the assesscr and collector of taxes shall issue the permit specifying the length of time and the location. SECTION 3. If the proposed transit show consists in whole or in part of any unlawful games or enterprises of any kind the permit shall be refused and if such transit show is issued a permit and the conduct of same is in an unlawful manner in whole or in part, its per- mit may be revoked by the Mayor and/or the city Manager, and fees paid shall be forfeited. SECTION 4. It shall be unlawful for any transit show to operate within three hundred feet of any private residences churchs schools or after its permit expires or after it is revoked for cause and all persons assisting in such operation shall be deemed guilty of violating this ordinance. The Chief of Police shall lave supervision of the policing of said transit show, SECTION 5. DEFINITION. "transit shows are transitory or temporary shows which have no intention of locating permanently." SECTION 6. Any person guilty of violating any provision of this ordinance upon conviction shall be fined in any sum not to exceed One Hundred ($100.00) Dollars and each days violation of this ordinance shall constitute a separate o�fense , SECTION 7. Should any part or section hereof be held for any reason invalid, such holdings shall not affect the remainder of this ordinance which shall remain in full force and effect. SECTION 8. This ordinance shall not apply to street fairs composed of local people for purely local charitable purposes and with- out profit. Neither does this ordinance apply where a transitory show or performance is given by a regularly established theatre or show house in -71ichita Falls, Texas,, or by its agents,, ctficers, servant s etc, PASSED AND APPFCVED this the A.D. day of 1935* Mayor ATTEST City Clerk
