NO 12077 ENTITLED "AN ORDINANCE CREATING A CITY MARKET, PRO-

AND VEGETABLES FOR SALE AT WHOLESALE OR RETAIL IN THE CITY OF
WICHITA FALLSS SHALL TAKE SUCH FOOD PRODUCTS TO THE CITY MARKET
FOR INSPECTION.9 SAVE AND EXCEPT JOBBERS AS DEFINED HEREINPRO-

nance No. 1207 entitled "An Urdinance creating a city market., providing
that every person firm or corporation offering fruits and vegetables
for sale at whole;ale or retail in the City of Wichita Falls, shall
take such food products to the city market for inspection, save and ex-

office of inspector, providing surety bonds prescribing the duties of

of September., 1935, shall be amended toread as follows., tO-Wit:
CTION 1. That there is hereby created and estab-
lished a city market in the CIty Of Wichita Falls, Texasq which will '
be for the inspection of all fruits and vegetables which are offered
for sale at wholesale and/or retail within the corporate limits of the
City of Wichita Fallss Texas*
SECTION 2* All fruits and vegetables hauled by truck
or other motor vehicTe�toor within the City of Wichita Falls shall
ptior to offering same for sale at wholesale and/or retail convey same

by a railroad company., which shall be inspected on the tracks prior to

SECTION 50 A wholesale distributor is any persons
fim, or corporation-w-Ho offers for sale fruits and vegetables in the
City of Wichita Falls with an established place of bus1nesa and who sells
at retail or wholesale to a hotel, restaurant, retailer., commission
house or to any other person, partnership, firm or corporation for re-
sale directly or indirectlys including the resale as a part of or in-
gredient of a manufactured article.
SECV_1DX--q* The City of Widaita Falls., Texas, will
charge an inspection fee as follows:
Itinerant trucker $0.50 per truck load
Foreign grower .50 it
Truck with trailer �(_ .75
One railroad car 17wm
Home grower .25 per day.whether 1 load or more.
Wholesaler .50 per truck load
Jobber ,50 11 it
All inspection fees for truck or other conveyance will include the use
of the city market for a period of twenty-four (24) hours.
SECTION 17* Any person, firm or corporation violat-
ing any of the provisions of this ordinance shall be guilty of a mis-
demeanor and upon conviction thereof shall be fined in any sum not less
than Ten (610.00) Dollars nor more than Two Hundred (0200.00) Dollarst
and each days violation shall constitute a separate offense.
MaTT In the event any section of this ordinance
shall hereafter be declared null and void or inoperative the other sec-
tions shall nevertheless remain in full force and effect.
SBGI�FWN Any ordinance or part of ordinance in
conflict with any provision of this ordinance is hereby expressly repealed.
SF99-1" Az;F That in order to prevent the sale
of unwholesome fruits and vegetables within said city and to protect the
health of the inhabitants thereof., an emergency is hereby declared and
this ordinance shall take effect immediately after its passage and pub-
lication as required by law*
